Hi forum members
can anyone shed any light on this one. I am in an IVA, my 20 year old son is now at university and surprise surprise the csa have contacted me to say that after 8 years they have finally tracked down his non maintenance paying father and hope to take some money direct from his earnings....
If they are successful will the iva see this as a windfall?

Maybe not as a windfall as such but if the money is due to come to you directly it may be seen as extra income.
Really a question only your own firm can answer with 100% accuracy.
Took them long enough to find him,had he moved to saturn?

Surely all the money should go to your Son [;)][;)] it will sure help with his fees at Uni.

lol, he was a tricky one... always avoided the csa with is self employment role, friends lied about where he lived etc. I gave up in the end. When a registered gas fitter plumber can convince the csa that he only earns 10k per year so that his assessment was to pay only 5.00 per week I honestly just gave up....its that 5 pounds per week that he hasnt paid that they are now trying to take off him. oh the irony of it all.
merlin what a wonderful idea, son would definitely love to receive some financial help from his father after all this time, even if indirectly.

I'm sure that if you played it that way with your IP then he would agree that your Son is in greater need than your creditors. Maybe even get the CSA to pay it into your Sons own account so you can't be accused of 'dipping' hehehe

I think the CSA are limited to who they can make the payment to. I understand it would be a lovely ending if Pauper's son got the money but in reality where debts are involved the money may well be swallowed up by the IVA.

I agree with Paul. I think the money will be paid to Pauper and it will have to go to.the IVA, especially as the son is now an adult.
Something that needs to be sorted out with the ip.

well if the csa obtain money from him I will let my ip know if it happens and Ill update you for the record. although i dont think we are looking at more than a couple of hundred quid here. He is expecting a new baby any day so no doubt that will take financial precedent for him over his debt to me....funny the lengths some people will go to to avoid paying out to the ex....lol

Couple of hundred quid is unlikely to be required by your IP. Tell him its money for your son from CSA that he never paid and there's a good chance under the £500 threshold you'll get to keep it. If they do class it as a bonus income for the year you'd most likely keep 50% of it anyway unless you have the 10% clause in your paperwork then you might even keep a bit more.
Logically and morally speaking I can't see the IP pursueing you for £200 that should have gone on your son to start with but maybe I'm too nice a guy compared to the creditors lol

Csa have always been a waste of time. It was much better when maintainance was sorted out by the courts.

The father of the child will only pay so much a month to you,the csa will look into is Di and tell him how much is has to pay, it might take him years to pay up, so you might only have to pay so much into your iva depending when your iva ends
I agree the CSA are a waste of time,glad they have caught up with him now 8 years of none payments silly boy.

Better sill is to work it out beween you.
Have never needed any one to till me how much to pay towards my sons, 12 years after the spit sill pay towards them getting to collage.
took them on hoilday each year,
days out on my one weekend off a month,
picked them up two days a week after shcool 20 mile rould trip.
ex only had to say the boys need and they got.
But then it was a two way thing, as she would never take any thing for her self.
I will never under stand how Dads can walk away from there kids.

I'm afraid my husband had to go to the courts as his ex wife wasn't interested in sorting things out amicably.

That as bad as dads walking away. but some woman do think they will get more though the courts or csa.
The kids should away come frist after a spit.
My ex made it hard the frist month or two, but saw I was not going to go away and we seat down to work it out amicably.

Strangely enough we all get on ok. We always saw his kids every other weekend and took them on holiday. They're adults now so the sort themselves,out!!
