Hi all, I have received an offer from nemo personal finance for mis sold ppi insurance on a mortgage I had 6 years ago. I have not made a claim, this letter just arrived out of the blue ! So I'm thinking if they have made this offer without me claiming do you think it will be a fair offer or do you think if I use the sister company of my iva company I will be entitled to more ! Also I have informed my ip of this offer and they are not sure if I will have to pay this into the iva as it is ppi on my mortgage which obviously are not one of my creditors ! Any thoughts ??

Hi Stapped - welcome to the forum - would have thought regardless the PPI payout would have been classed as an asset - therefore payable across - if you do make further PPI claims - expect it all to either be retained by creditors or to be paid into the IVA pot - meaning all the creditors get a bigger divident

Is it not owed to my current mortgage company rather than my creditors ??

agree with ginger, irrespective of whether your mortgagee is a creditor or not, PPI is classed as a windfall/asset therefore payable into the IVA pot for the benefit of creditors

I also agree, it will have to be paid across.

So to the other question ! If they have made this offer out of the blue do you think it will be a fair offer because if it is all to be paid into the iva I will want as much as I can get to get me closer to paying off the full amount that I owe ??

I have no idea how much it will be. Why don't you contact them and ask.

You say that it is from a previous mortgage. If you are no longer with the same provider then it shouldn't go them anyway.

But had the ppi not been added my mortgage balance would £000's less than it is !!

Hence maybe making a remortgage possible to clear my debts ! So I could argue this as being one of the reasons I am now in an iva !!
