Hi there,

I completed my IVA in August 2011, i got my certificate of completion a month or two later. One of the debters including in the IVA have sold the debt on to a debt collection agency who are now chasing me for payment. The letter said the debter passed it on to them in October 2011, how can this be? Surely as this was part of the IVA i no longer have an obligation to pay this debt?

My IVA was with Debt Free Direct but on the letter of completion it stated that they as it is completed, their service to me was over. Can i still pass this letter on to Debt Free Direct and have them respond to the debt collection agency?

Scrumpyjack - well done on the IVA completetion - if the debt was included in the IVA - then regardless of it being sold on , there are still bound by the terms. Recheck your proposals - again - contact them them and mention the IVA - if they continue to harrase you then report them to the OFT. Sit back back and ask them to "bring it on" :-)

of couse you can. If it was include in your IVA which has now completed then the debt is satisfied and you no longer have any liability towards the debt. Contact your IP and they will sort it for you R x

Hi Scrumpyjack - I would send a strongly worded letter together with a copy of your completion letter and tell them that the debt was included in the IVA and it should now be written off. Tell them that if they continue to harrass you then you will take it further.

Then, as ginger suggests, tell them to bring it on!!
