i have been in a iva for the last 16months.now we have had a letter saying we owe £33000 from the sale of our house which we surrenderd 9 months ago.the question is could my wife join my iva as she is liable for her share my share as been added to my iva

Your wife could propose an IVA in her own right. Does she have other debts to include too? Worth talking to an IP aboout this. x

how would it work when they use both our income to come up with a disposable ammount to pay mine.we have no more money would she be better going bankrupt.we just don't know which way to go

Hi

Take advice from your current IVA provider. Bankruptcy is one option for your wife but an IVA may also be an option

Hi there, as Andy says why not have a chat with your IP about your wife and they'll be able to advise on all debt solutions for her and bankruptcy can be discussed too. There will be a solution, give them a call. x

If this is your wife's only debt, then an IVA would be unusual but not impossible. If you no longer have assets which would be at risk from bankruptcy proceedings, I would give that option serious consideration.

yes melanie my wife has two other debts £900 + £3000 which she pays £20 per month which she started when i enterd iva.no assets at all

As Mel says above, if you do not have any assets then bankruptcy may be the option for your wife. Best to speak to 2 or 3 companies, you could discuss with your company first as it may be easier for you to do so.

It may be possible to get the mortgagee to accept a dividend from your IVA alone, given that your wife appears to be contributing her disposable income to your own monthly payments. If this is not acceptable to them, and she is forced to go bankrupt or enter into her own IVA, then your own payments will be affected. Speak to your IP for specific advice as to how this is best addressed.
