I completed my IVA in August 2011 and received my certificate of completion shortly afterwards. In the past few months i have been receiving letters from a debt agency who seem to have acquired the debt from my creditor who was Intelligent Finance and was a loan for £20,000. This devy agency are demanding payment of £20,000 even though this formed part of my IVA. I sent this letter on to Debt Free Direct who dealt with my IVA and didnt hear anything back. Since then i am now getting letters from a solicitor on behalf of the debt agency damanding payment. I contacted DFD who said that they have tried to contact the debt agency but as they no longer act for me then they have no authorisation to speak to the debt agency. Surely as they dealt with the IVA and got paid a considerable amount of money to do so, they should act on any legacy problems attached to that IVA? They have suggested that i send my certificate of completion to the debt agency but i am worried this hassle is not going to stop! What should i do....

Completely ignore the letters and phone calls. They will then attempt to get a court order and only succeed in getting egg on their faces. You have completed the IVA, the debt was included and satisfied no matter that it has been sold on. It will be a pain but if it gets to court then you have a right to claim compensation for stress and worry over the harassment you have suffered ;-).

Send the completion of certificate and include a summaey of charges you will apply if they continue to contact you on the matter that you will request in any court hearing if they pursue this debt.

If it is included in your IVA a judge will not be impressed.

I would suggest.

Response to further letters, £150 per letter.

Attendance at court £750 per day + expenses + 40p per mile travel.

Totally agree with the advice from herbekj.

DFD are within their rights not to help any further. Once they send you the completion letter then all their action is complete (don't forget their fees have stopped then so they would be working for free).

When we got our completion letter there was a seperate letter telling us this and giving advice on what to do with problems in the future (not DFD).
