Hi Everyone,

Been coming back to this forum everyday for a couple of weeks now and it's helpful to know there are people that would appear to be just a few weeks ahead of us in the IVA process. A lot of the questions I have are being answered in many of the threads.

I'm still to make that initial phone call/fill out the enquiry form but I'm on leave for a couple of weeks now so hope to finally get that done very soon. I'm still worried about my first question on the forum though.....that is, we live with my partner's parents and pay half the rent that we would pay when we eventually get our own council house (should get something within the next 6 - 12 months) Plus most of the utility bills are in her parents' names....

The advice on the forum suggested putting in an estimated I&E, but how could we justify certain expenditures eg rent when we don't have documented proof of how much things will cost. Sorry, feel like I'm rambling here but I'm just worried without cast-iron black and white evidence of our expenditure, our IVA applications won't be taken seriously.

I'm also ashamed to say that a larger amount of the debt was through my gambling which was done to try and get out of this mess. Haven't bet in two/three months but again I'm very worried our application will be turned down because of this...

Cheers
Paul

Hello and welcome!, I think as far as your current situation goes, you can only put down an I&E based on your current circumstances, you also need to make your IP aware of the fact you are waiting for a council house and your expenses will alter at that point, but if you don't yet have a fixed timeframe for that, it will be difficult to know how they could write the proposal to alter your payments after a set time period.

Perhaps it might be better to propose a DMP for the current time, until you get your council house and then you will know your outgoings and can then look at an IVA?

First of all I would not be concerned about the gambling since you were trying to gamble out of trouble and did not gamble yourself into trouble. There is a difference and the former does not mean you have a gambling addiction.

The I&E will be down to discussions with the IP and provided everything is disclosed to creditors I believe you will have little to be concerned about. The most important thing is affordability and if you know you will have money to fund an IVA when you get your own place an IVA is certainly a viable option for you.

Hi Paul

You might be able to get your partners Parents to write a letter to your IP firm staiting how much you pay them to cover rent and Utilities.

Good luck

Try not to let the gambling worry you too much, it is unlikely to be a problem as long as you can demonstrate that you have not gambled recently.

We have had IVAs approved recently where gambling has taken place.

Speak to a few a companies before making a final decision :-)

Thanks all, and thanks Kelly as we are thinking of going through MG so I am especially interested in your take on things. I'm done with gambling as it just made a bad situation worse and I haven't bet in 2-3 months and have no interest in doing so. Would placing no bets over this time be enough for the creditors or would they require a longer period. I haven't self-excluded myself on various betting websites as I have no interest in using them, again would this go against me?
Thanks
Paul

Hi Paul
I did the same as you and my IVA has been approved in principle just waiting for the creditors meeting. I have self excluded from all the sites and although I will never do this again it gives you peace of mind that you don't have the option.
