Hi, from reading in here it seemed as though anyone putting a claim in for PPI a lot of the banks were just paying up and not really fighting back.
My work collegue (we are supporting on another, both of us are in an IVA different company's though) had to put in a claim via her company and has received a letter yesterday from RBS stating they have investigated the claim on (her account details) and as far as they can determine there is no claim to answer and she is not entitled to anything as they have proof she was told about the PPI etc as she signed a form with it on etc.
Are banks beginning to fight back against the floodgates or is this a one off.

The majority of big banks already identified who was owed PPI, some even went and contact their customers telling them to how to claim it off them, usualy when a letter is sent in there is no long investigation, they put your name in, it either says yes or no and they pay out if you have been mis-sold the PPI (all the policies which were mis-sold or illegal were identified long ago by the creditors!!)

Of the 10 credit cards I had, (I shudder when I read that), 2 were with Barclaycard, a Visa and a MasterCard., on which I agreed to have PPI on at the time. They refunded the PPI on one card but refused on the other. Very strange!

My PPI claims company wrote to me a couple of weeks ago to say HSBC have advised they will not payout PPI to people in IVAs.
Apparently lawyers are looking into it but I agree it looks like banks have started to say no.

I dont think they have a choice do they? If the PPI taken out and charged for was missold then they have to pay it back surely?!?!?[:0]
I know many are 'off-setting' against debt outstanding but they cant just blank refuse? Saying that im not surprised by HSBC, they always seem to be the problamtic ones with IVA's (They certainly were with mine[:(!]!!)
Can any of the IP's offer any info/advice?

RBS have said no as well to a poster. But if they just refuse to payout look at it as a blessing in disguise. I need to cut n paste something from the FSA website I'll put it up on a new post in the next few days
To be fair did you think the banks were just going to take it on the chin, I guess and it is a guess they set all that money aside for tax off-set reasons rather than total payout.

Theoretically wouldnt this be good for people in IVA's, as in if they all refuse to pay out to people in IVA's (and it is deemed to be legal not to do so)then its no longer a reason to delay closures as there's nothing to chase?
An intersting question would the person be able to claim once they exited an IVA? I suspect not.

It would be interesting to see what the IP's take on this is as if the banks are not paying up is it worth EIF and the like forcing people to claim even though they say they were not mis-sold it, but just to check if they was anything from years ago.

Barclays were brilliant with our PPI - start to finish in 4 weeks, its irionic though that they were our biggest creditor and they have refunded more than we owed them when we wnet into our IVA!!!

I have to agree with you there Dixie, i didn't have any debts with Barclays but my partner who isn't in an IVA did, he was done and dusted within 4 weeks of claiming himself, shame others can't work to that!

Barclays can probably afford it as they benefited from years of manipulating the LIBOR rates !!

I believe that there will be a challenge mounted against banks who are seeking to off-set PPI misselling claims againts their debts. As with all things legal, however, Romer was not built in a day.
