Hi, this is a bit long winded and not quite sure how to word it all. Ive been in an IVA now for 5 years with a year left. I've recently asked to make a full and final offer due to struggling to make payments and my parents have offered the money to do this. I submitted payslips etc and my IP - Payplan have come back querying an amount on my payslip which is for a Credit Union Loan I took out 2 years ago.
I emailed them back then as I took it out to buy a car as mine had died, they didn't reply which is usual for them and have had copies of my payslips for the last two years at my annual review and its never been queried before. So I was under the impression it was okay. I didn't buy an extravagent car it's on an '03 plate and only cost around £2700.
Payplan are now being quite nasty with me about this wanting copies of everything relating to it which I now don't ahve but am trying to find it for them. Being honest Payplan haven't been the best with me they were great until my IVA was set up but once I started struggling they weren't helpful at all. I feel like they are more on the side of the creditors than looking after my interests too.
Not sure what to do about the credit union thing, I've actually added to it a couple of times due to my finances car repairs etc. Any advice appreciated am at my wits end and worried sick.
I've paid into the IVA for 5 years with a 1 year debt management plan before this and just want it all done with.

It is potentially a breach that you borrowed money without the consent of the IVA supervisor but this can be addressed within the full and final variation meeting. It is possible that your parents have been helping and if so they effectively have been repaying the credit union which should get some sympathy from creditors.
Give Payplan what they need and hopefully creditors agree to the full and final and forgive your mistake.

Thank you Michael, i'm worried sick about all of this and haven't been sleeping. Yes my parents have been giving me money my IVA currently shows a hundred pound per month defecit as my maintenance from my ex reduced so they've been paying £100 per month into my account.

Sorry to post again Michael but what worries me is the fact that I've added to the credit union loan in fact only recently due to my new car needing repairs

This is what is worrying me as well.

Explain this to Payplan and it should be fine. The borrowing was a genuine error and was for essentials not luxuries and without it you could not have got to work so the IVA would have failed. While you made a couple of mistakes your intentions were sound so I think creditors will not be too harsh. Payplan should draft a sympathetic variation which should get accepted once they have the bits of info from you.
If in doubt speak to Gemma who posts here and she may be able to get this moving quickly within Payplan.

I am suprised that this has not been picked up during earlier annual reviews, as the deductions would have been clearly visible from an analyis of your wageslips. Your IP can provide you with retrospective permission, and if you have maintained conributions correctly since buying the car then I hardly think this is too much of an issue to be frank.

Thanks Melanie, that's what i thought why wasn't it picked up it's clear on my payslip. i have maintained payments but last month paid a lower one due to car repairs, school uniform, my glasses broke etc. I have the full and final offer to go through off my parents which is basically what I owe but would just clear things sooner for me.
Being honest i haven't been impressed with my IP they were great until the iva was set up, I had to ask for a change in Case Worker as he was rude and ignored emails sent to him. I've also found my Case Worker changes at least a couple of times a year. but hopefully I'll be rid of it all soon.

I am sure you will find a solution to get this resolved amicably. A shame that you feel that you have had a less than positive experience with your IP firm, but working together and sharing the difficulties you encounter throughout the life of the IVA is key to a successful relationship in my experience.

Hi need more help.
I've sent the information to payplan about the credit union explaining everything and they obviously don't read their emails so have replied with yet more questions which again I've answered.
The thing is Ive had a full and final offer off my mam which is for the amount I owe and if this drags on much longer it's going to be for more than the years payments I owe.
Payplan have told me 3 months to set up a creditors meeting, is this right. I've read some more posts where they are having the same problem.
Seems all Payplan want are more and more customers and don't seem interested in the ones they have at the moment.
Any help appreciated please

This seems way too long and for people in trouble their IVA could be in default before tha variation is called!
Contact Gemma from Payplan who posts here and maybe she can speed things along.

We try and process variation meetings the same week that we recieve all supporting documentation, but sometimes are not able to manage this due to scheduling bottlenecks. Three months does seem to be a long time, but perhaps they have a long backlog - it is sadly a sign of the times and I have never done as many variation meetings as I have done this past year.
