Just received a "cold caller" type letter from some guy who thinks he can do better for us than the firm we are already with. The letter is off in the bin but I'm annoyed firstly that this guy knew we were on an IVA and how far into it we were. I wasn't aware that this information was in the public domain! Already fed up that I've had to inform my Manager, work for an insurance in the UK but governed by CBI so have to comply with their Fitness & Probity Regs, still uncertain what impact this is going to have on my job as I'm a Manager!

It is on the insolvency register for all to see.

Your name, address, date of birth, date IVA started, the court it was agreed in and the name of your IP.

It will remain on there until you have completed your IVA and recieved your completion certificate.

My details have been on there for 6 years and 9 months so far but who is counting.

It is there for all to see but not many people know of it's existence apart from those with an IVA and those in the trade so to say.

Cold calling is illegal in the UK, unless you gave permission for your details to be shared . Do you have any idea where they would have got your contact details from?

I had several of these in the first 2 years of my IVA. It freaked me out at first, as they implied the IVA was a rip-off and I could wipe out more of my debt. I'm sure I contacted my CO at Payplan who explained they were from companies dealing with bankruptcy. I just binned them after that. As an aside, I wonder if there is any protection re: people needing to hide their contact details, such as survivor's of domestic violence? Hope so. x

These letters seem to be rearing up again and my best advice is to ignore but it's up to the individual how you deal with them.

Honestly that register as a lot to answer for.

Mel - I think it is a letter they have had rather than a phone call so they will have had the details from the Insolvency Register.

People should have to register and pay for information on there and the fees should be sufficiently high enough to discourage the ambulance chasers and you should also have to give a valid reason why you need to search it.

Can I just ask, i know we go on the insolvency register but we are looking to move next year with the help of my partners parents and royal british legion, however i am a survivor of domestic violence and i was wandering when we move will our address details be updated on the insolvency register? The reason why i ask this is because my ex husbands mum works for an insolvency practioner in birmingham somewhere and i know she will check for new address details...we have no contact with my ex husband or his mum due to constant abuse to me and my children. I don't think they are updated but I believe you can ask for address details to be withheld where the person in the IVA/BR is likely to be in danger.

I would say that if your ex MIL used these details to try and track you down she could be in serious trouble.

They do not automatically update.
My ex wife who is in a joint IVA with me still shows up at our original address even though she changed address 3 years ago.

Seems unfair on the new residents of a property that the address is shown and they are likely to get mail shots as a result of this.

I hope she doesn't get hold of our address because she will pass it on to him and it will definitely put our family in danger.

You can ask to remain anonymous address wise Spanna but I've no idea who you approach about this.

This must be a worry for you, in certain circumstances we can apply to the court to withhold your address from the insolvency register.

Ultimatley the decision is one for the court but certaintly something we would consider
