Hi

We have just had a full and final offer on our IVA accepted and have finished 3 years early

We were asked to fill out forms to claim any PPI but we didnt have any on the debts that were within the IVA

However we did have PPI on a first Plus loan which was paid in full and settled prior to the IVA being taken out

if i claim mis sold PPI on this would i have to pay in to the IVA as the settlement letter states any PPI claims received would be distributed retrospectively amongst the creditors, or would this be for debts only covered in the IVA

Hi. As things stand at the moment that First Plus PPI refund would be an asset and therefore payable into the IVA. The timing and to which loans it relates are not relevant.

That said, things PPI change daily !!!

Yes, I think this will go into your IVA and will possibly be a large chunk of money

I agree with Andy and Foggy - it would be entered into the IVA for the benefit of your creditors.

Many thanks for the replies.Will contact them and get them to pursue as a little bonus for the creditors then!

Shame i wont be able to keep it!!!

You do need to check the terms of your IVA proposal to ensure that this is covered by the assets clause. Not all IVA proposals include this, and your IP should be able to direct you to the appropriate clause.
