They probably can. My advice is to complete and return the forms. You will see many posts on this forum in relation to PPI.

If you can honestly say that you were not mis sold PPI , for example if like me you would have asked PPI be added if it wasnt offered to loans , credit cards etc and therefore dont feel you were mis sold it, then perhaps ask for a PPI disclaimer to be issued.
DFD did this for me, whereby i signed to agree no PPI was mis old and that I agree i would not attempt to claim any when i was discharged rrom my IVA.
I was adamant that to claim PPI would have been frauduelnt on my part, as in my eyes, it covered me for what it was intended to and fortunately i never needed to make a claim. I genuinely felt to attempt to try and claim it back on a supposed technicality that it may have been mis sold, even though I had never tested this as I hadnt needed to claim would be purely opportunistic and jumping on the bandwaggon.

Complete the forms,it does no harm whatsoever. If there isnt a claim to be made then your IVA company wont get money that they werent entitled to.
As for knowing that you had it,people need to realise that there are numerous reasons for it being mis-sold and you didnt always know it was added to accounts so without investigating you cannot say you didnt take PPI. You may well have said no to it,but they may still have added it to accounts without your knowledge.
Let your IVA company investigate claims and get your IVA over and done with and move on in life.

Hi and welcome to the forum. I would sign the forms, let them complete their investigations and get the IVA overly in a timely fashion without any added delays. Some of our posters were adamant they had no missold PPI but when invetigated found a few thousand for the IVA pot. It will just avoid lengthy delays in my opinion.

Hi Blake. Yes, they could fail your IVA for non-compliance.
You say that PPI was not part of your agreement --- in some cases this could be true, but in the majority of cases it is captured as an asset, although not specifically referred to.
As said above, best to sign and let them get on with it -- I was adamant that I didn't have any PPI -- yet they found over £8k !

They can fail the IVA if you fail to co-operate with them, and this includes failing to assist with a PPI investigation. You have nothing to gain from not completing the forms, as the IP will go ahead without you and then closure of your case could be considerably delayed.
If PPI is found to exist on your accounts, you can then let your IP know whether this was sold to you because you asked for it, or the loan was conditional on you having to take it out - the latter of which could constitute mis-selling.
