Hi we are just coming to the end of our fourth year in our iva only two years left,A couple of months ago we were asked to fill out forms to claim ppi we didnt do this as we believe we were never missold it,Today our iva company have told us we have to fill in the forms and they will decide whether we were missold or not.Can they make us fill in the forms? Because i am led to believe thats its illegal to claim for missold ppi when you were not missold it.

They cannot force you to fill in PPI forms if you beleive you was not mis-sold it.
Ask to fill in a declaration of no claim form instead, attempting to claim non mis-sold PPI is illegal and your IP knows this.

They may bluster and make all sorts of breach of IVA noises but its just a pressure tactic.

It is illegal to claim that PPI was mis-sold to you, if you willingly sought the insurance or agreed that it was needed. I guess your IP needs to check out that you were actually suitable for the insuranc, or that it has not been sold to you without your knowledge.

I am with your IP on this one I am afraid - let them conclude their investigations, and when it comes to the time they confirm they believe there are claims to make, you can have your say then.

Its all down to creditors not really contesting claims of mis-selling. Its a bit like shooting fish in a barrel now. Pity that so many people gain out of the apparent mis-selling, except those who were wronged!

Wonder how many ivas could have been avoided if people had chased up ppi claims before becoming insolvent?
