Hi everyone, this is my first post. Hope somebody can offer advice.
It has been almost 10 months now since our full and final payment offer was accepted and paid. We received a letter saying thank you and that cc would be with us within 6 months but still haven't received it. It seems to be because of ppi. We had a letter offering to pass our details on to their ppi company over a year ago & we replied within the time given & opted out & asked them not to pass our details on. Never heard anymore until 6 months after settling when instead of our cc we started getting phone calls numerous times a day from their ppi company. We told them we had opted out & settled so they offered to claim it & give us the money. We keep getting conflicting info from them & just want this over!!

Also, why have they passed our details on when we asked them not to?
I don't know why they won't send our cc. They are now saying we won't get a cc until we let them claim our ppi. Surely, it is not in our creditors interest to claim our ppi, take, what I imagine would be a sizeable cut then give them a bit back? We've been waiting long enough & just want to get on with our lives. The only people I can see benefiting from this is Grant Thornton.

Grant Thornton are very slow at sending out completion certificate, especially at the moment. My F&F payment was last July and I know there are people who have been waiting a lot longer for their certificates.

As far as PPI goes I see it is fair for the creditors to get beck anything they can (alrhough not of course if uou have paid back 100% of the debt plus statutory interest) as it increases their dividend. Although does make me wonder why it's called a F&F payment but there you go....

I had my MVM meeting last month for the creditors to agree to cases being closed before PPI is fully investigated and supposedly should get my certificate by the end of June. There isn't a lot of June left now though..

If you are sure there is no PPI to claim there is

Sorry - fat fingers!

There is a form you can fill in to say you have no PPI and won't try and claim it yourself. Otherwise I advuse agreeing to EIC investigating.

Hi kst101, thanks for replying. I hope you are one of the lucky ones & do manage to get your cc by the end of the month! I don't mind not getting a penny of the ppi myself, if there is any I just don't understand why the creditors can't just keep it, without wanting to claim it back just so they can take a cut of it for themselves. What I'm annoyed at is Grant Thornton letting us opt out, never mentioning it at any stage in our final settlement then waiting until we are due our cc before making an issue out of it. Now our ip is holding us to ransom, saying we can't have our cc until we let them claim it.

I satisfied my IVA in full in March 2012. I was told that my certificate would follow within a couple of months. I was then sent a letter by my practitioners, Varden Nuttall of Bury, saying that they were claiming PPI. It was never explained to me that this would stop the certificate being issued, and therefore my wife and I show on the insolvency register! This is affecting our lives immensely and when we speak to VN they just say that they are dealing with it. This has been a nightmare and it is showing up as still in the IVA at CRA's. What can be done to get this sorted? I was told that I would not get a penny but offer letters have come through. Who gets the money? How can I get closure?

I know what you mean Tallchris, it's a nightmare isn't it. There is no justification in them taking so long and causing undue stress and worry. As for the ppi, do you still have your original agreement with the terms & conditions and is there any mention of ppi? There is no mention of it in mine at all, it isn't mentioned as an asset or anything. It's flipping annoying because I can't even get my daughter a contract phone or anything and she's at an age where she could do with one for safety reasons. I would make a complaint if I were you, that's what I'm thinking of doing

So who do I complain to?

The correct complaints procedure is to go through the IP's firm's internal complaints ... which can take three months ... then you can complain to their regulators.

Personally I would bombard the regulators at the same time as the internal procedures, as I feel the regulators should be made aware of upcoming problems and they might take notice if they get enough noise made outside of the system, as the system is designed to quiet the furore before anyone notices.

I'm not sure really! Firstly I would contact their customer services or internal complaints dept and see if that helps. I think one of the experts on here is from the company who dealt with your iva so maybe he might help. Hopefully someone will come along to give us both some advice soon.

I would like to know who the regulators are too and any contact details for them? Does anybody know if Grant Thornton have a complaints dept or would it be customer services I contact? Thanks in advance to anybody who might be able to help

Find the regulators here:

http://www.insolvencydirect.bis.gov.uk/fip1/

You will need to pop in the IP's own name, not that of the company.

GT do have a complaints "department", but keep the details firmly hidden away -- if you contact Karol Wilson at this email, putting only "IVA Forum" in the subject line, she should be able to point you in the right direction: IVACustomerServices@uk.gt.com
