Hi all,
After a quick scan on this forum I see that many are in the same poposition as me in waiting an unreasonable abount of time for the CC to be issued.

I have been waiting almost 9 months for DFD to issue mine. Every time I've called them they keep telling me how my completion is a "priority", also it's "literally at the top of the pile" and it'll be "very soon" (although they wont specify when), and now I'm getting desperate for everything to be completed.

When I originally took out my IVA in 2007 their sales team painted a very rosy picture of the future by giving me the patter of "eveything will be fine in 5 years blah blah blah". They also said that I'd have to wait "around a couple of months" for the CC after my last payment. I have kept to my side of the bargain by paying 60 monthly payments of £400 but it now seems that DFD can't or wont stick to their side of the deal.

Nine months and counting is in my opinion an unreasonably long time to wait for a CC and any advice on what further measures open to me would be greatly appreciated.

Hi Pete. Yes, 9 months is an unreasonable time -- indeed the usual quoted 6 months is an "up to" target and is also too long for something they should have been on top of.

However, I suspect the fly in this particular ointment goes by the name of PPI ! This little problem wasn't thought about several years ago and is causing somewhat of a storm.

In the delays of closure due to PPI and VAT league I am afraid 9 months is quite short, we have posters waiting more than 2 years !

Best advice is to keep badgering them -- oily wheel getting the oil and all that

Hi Pete and welcome, sadly as Foggy has said this a problem that has blighted many IVAs recently. Have you been approached regarding this matter and if so is it EIF dealing with it? If so the only advice I can offer is make a phone call to them and find out what is going on, they unfortunately are not the most effective communicators. Good luck and best wishes.

Both good replies above and I consider it too long too but what can we do? The ball is in their court but do keep badgering them for at least a latest date when this completion will happen and anything before this will be a bonus.

Thanks for the replies folks.

The PPI is not an issue any longer. Just before my final payment I had all the hassle from EIF and DFD about claiming PPI.

I explained to DFD that I had never taken out PPI on any loans but they wouldn't believe me. I got so fed up with the stalemate that I told them that considering I had never taken out PPI any claim would be fraudulent and DFD would be condoning me to make a fraudulent claim. They soon backtracked and sent me a declaration form to sign. The form basically said that I give an assurance that I never had PPI and will not try to claim after the IVA finished.

This was done about 6 months back but still waiting. I'm wondering if there is any course of action regarding mis-selling because as I see it they painted a rosy picture of things when they sold the IVA, but in reality they have failed to deliver.

I'm really fed up with DFD because all I get is false promises and fobbed off everytime I call, and can't help thinking if I could prove mis selling I could just use the money I've paid to give to my creditors personally.

Hi -- I very much doubt you could prove miss-selling, as many of the delaying issues were not even in sight at the beginning of the IVA and I am sure the intention of all parties was a smooth ride.

Playing devil's advocate, and talking from a totally untrained perspective: If miss-selling was to be proved that would, presumably invalidate the IVA -- which, in turn, would invalidate the protection it provides. Tjis would enable the creditors to add back the last 5 years interest and possibly late payment charges --- your debt could double overnight.

At the end of the day it you have benefited from frozen interest for 5 years, along, possibly, with a chunk of your debt written off.

Initially you have the option of pursuing a complaint through their internal complaints procedure, then, if no joy, a complaint to their regulators.

That's true Foggy. I'm just getting frustrated with everything at the moment because until this is all sorted I'm unable to be included in my partners mortgage. Everytime I speak to DFD I just seem to be getting nowhere. Been reading some real horror stories on this forum about people waiting a lot longer than I have for their CC and it's disgraceful. They never mention the possibility of lenghty delays to the process when they're thinking about their fees as you sign up.

Hi 502emu - as stressful as it is unfortunately some people have had to wait a lot longer than 6 months as well. Glad to see Matt on the forum this afternoon picking up any issues, I'm sure he'll get on the case for you.
