just received tax credit rebate for 2012/2013 started IVA may 2013 is this classed as a windfall or money owed to us for having a less wage through 2012/2013

How much is it? Declare it to your ip and expect to pay some of it over (I'm assuming its several hundred pounds).

If your IVA payments were based on a lower figure in my opinion this would be a windfall. If less than £500 you could possibly keep in but you need to let your own IP know to be sure.

I would say it is an asset, as your right to the money was derived prior to the IVA, but in reality you could probably successfully argue this either way.
