hi I am in an iva and they are asking me to re mortgage to release the equity. It is a joint mortgage and my husband is not in an iva and he is not happy to do this, what happens if he refuses? can we say no to re mortgaging?

Hi Sue and welcome to the forum

Did your husband give his agreement to re-mortgaging when your IVA was originally set up? Assuming that he did, why has he changed his mind now - and do you know whether you are able to get a re-mortgage at all whilst you are in an IVA?

I'm sure that my agreement has this re-mortgage option on it .
I'm worried about doing this but thought it was a must do thing .I was thinking that if I'm in an I.v.a I would be un able to get a re- mortgage anywhere . What are the chances of a bank letting me re-mortgage pease?

Michael has posted tonight to confirm that he knows of a mortgage company that is allowing re-mortgages to persons in an IVA. I am waiting for him to confirm their lending criteria, which could be good news for creditors and our clients to enable compliance with the equity release provision.
