I HAVE JUST FINISHED 5 AND HALF YEARS STRUGGLING TO MEET MY IVA BUT I HAVE FINISHED !! I have been asked to pay a further year as my home cannot be re mortgaged due to my age and balance owing. I developed a spinal condition last year which left me in wheel chair and I cannot work longer than 6 housrs due to double incontinence - I continued paying the monthly despite all this - and I have noww been refused a reduction bep[ite my begging emails

Hi and welcome

Have you filled in a fresh income and expenditure form ? your payments should be affordable.

It is not unusual to extend your IVA by one year if you can't remortgage

Thank you, I would love to apply for a fresh income and expenditure Form ( I am with DFD)and I had a letter stating that I am in breach of my Agreement due to having a catalogue - I didn't think this was a form of credit.
I have had to take a lesser post due to my wheel chair and being doubly incontinence - this was £3,000 less than my salary before illness and the condition - transverse myelitis is incurable - I spen 6 months in hospital last year and I kept up to date with all my payments - if I was reassessed I know they would reconsider the amount

I also can only work 6 hours aday due to toilet - and so my income is down £3000 and I'm on 4/5 of this lesser salary - I sent payslips proving this and medical reports to prove I was telling the truth .

Also the catalogue payment were on previous statements I'm submitted too and no-one advised that I was in breach.

I have already paid my agreement for additional 6 months - so I am effectively being asked find a 18 month extension to the original Agreemant

Would I be better off with a DRO ? and what is a DRO lol

Hi -- you do not qualify for a DRO -- which is a simple form of Bankruptcy. It is for those with debts less than £15,000, no assets a,d a disposable income of less that £50 per month.

A catalogue is a form of credit, but generally these credit limits are relatively low and I hardly think that you taking out one is a major default. How much do you currently owe on the account?

If you have demonstrated to your IP that you can no longer afford to make the contractual repayments, then they are being harsh in not allowing you a reduction, and given your health and the stress this is causing I would have thought a variation to accept what you have paid in to date would be the most sensible way forward for all parties - but this does however assume that you have little or no disposable income. What do you feel you could realistically afford to pay now?

To be honest due to ill heath I have £6,000 less a year income than the years before and it would may well cause me to have to rent my house out and live with family - this will not help my health. I have pointed out to them that suicide is the only cause of death with my condition as it's a neurological symptom to have deep depression and TBH this is pushing me -- I am at my whits end

Foggy,

I have paid £12k out of my £19k debt
so would a DOB help?

I am more than happy to refill my income and out goings forms and I just feel lost ... thank guys for help[V]

I Would be able to find £50 a month at a push *( I live a Spartan life) My IP (debt free direct)
want my £148 a month. -

I don't want to extend the time any longer - this is stopping me putting house in my children's name as I am 90% likely to develop MS and really need to sort my future care etc if I can[B)]

I owe £80 on catalogue.. I did not take it out , I've had it since 1999 and when my IVA started I used it for Xmas and Electrical goods for my home - "this didn't involve me taking out credit"[:(]

When I took my IVA out I told the first person I spoke to that I was living on a minimal amount of money in order t=fro them to think that I was making an excellent effort to scrimp, but I was silly, they used these figures for the whole IVA ( I know of people who claim hairdressers, nail bars, gym etc but I had sentenced myself to a life without out any quality at all .

You have the right to ask for a full income and expenditure review at any time. I would ask for a variation to be put to your creditors on payments to date be accepted based on the information you have given us.
I would also look under the members list on the forum and seek Judith Anderton who works for DFD and email her via her link to get her hel.

Thank you - I will keep her details - I've managed to get a full revaluation of my income and outgoings - but due to the catalogue - which I used since Sept 2013 ( after my original 5 years had ended ) as a breach of my Agreement [V]

You should not be treated like this for an £80 debt, and given your health and the stess you are under you deserve much more support from your IP than you say you are getting. I really do hope that someone from DFD will spot this post tomorrow and invite you to make contact with them directly to see if they can expedite this matter.
