I was in an IVA which was successfully completed around 3-4 years ago. I am about to apply for a mortgage and on the brokers form one of the questions states :

Are you currently or have you EVER had a credit agreement default, CCJ or an IVA registered?

I am no longer on the IVA register and its not listed on any of the credit check agencies. Do I HAVE to answer yes to this? As this would probably cause them to refuse the mortgage? Would they be able to find out?

You must answer the questions honestly an the broker can then place the mortgage accordingly. Some lenders want major daylight between the IVA and new borrowing whereas others are not so strict.

I would strongly discourage you from answering NO to this question if it asks whether you have EVER had an IVA because this is clearly incorrect. Given the time since your IVA was completed it should be possible to obtain a mortgage truthfully, depending on who you approach and dependent on your other circumstances.

Thanks guys. I just thought it was unfair this far down the line to still have to declare it. I have mentioned it to be broker and he thinks its still possible to get a mortgage approved. We shall see how it goes, fingers crossed!

Just make sure your broker knows his stuff before he allows any credit searches to be carried out. Good luck, let me know how you get on.
