Hi,

My wife had an accident in our car a few weeks ago, we had it back once from the repairers and then another fault manifested and there is a possibility it could now be written off. My question is that when/if I get the money from the insurers (should be around 5k) can I spend this on a replacement even though I'm in an IVA? I would need to spend the whole 5k to get something reasonable as it's our only car for work and has to last us 5-6 years!

The vehicle was likely excluded from the IVA so you can go and purchase a replacement. However double check with your own IP.

Absolutely you can use the insurance money to replace the car. I have your e-mail and will respond formally tomorrow.

Good job you are with Melanie and not one of the other firms. You may not have been given the correct advice and certainly would not have been able to deal directly with your IP.
