Hello, my ex husband is entering into an iva. He has informed me I need to sign papers as my name is still on land registry for our house? We have divorced and although my name is still on the mortgage (he can't get another) our divorce papers exclude me from any financial responsibility with regard to the house. Do I need to sign, or is he trying to con me?

Hi Tracy. As you are on the deeds as a joint owner of the property your signature is required on the RX1. This is a restriction placed on the deeds which ensures that the IP is informed if an application for any sale or loan against the property proceeds.

This does not oblige you to his IVA in any way and should not affect you if you have no claim to current or future equity. If in doubt speak to your solicitor.
