hi everyone, I'm wondering can anyone shed some light on a letter I've received today from the enforcement of judgements office. It's a notice of intention to stay enforcement. It says 'take notice that it appears to the EJO that enforcement of judgement in the above matter ought to be stayed on the ground that having regard to the liabilities of the respondent the property of the respondent ought to be administered for the benefit of all creditors. I've googled this I have no idea what it means! Please help!

Hi

Stayed would usually mean a "hold" or "postponement" of any action

I don't know how the EJO works, but the way I read it is that they have decided that enforcement on behalf of the creditor who has started the action would only benefit that creditor and that it would be more equitable if any repayment of liabilities was shared between your other creditors too ... as it will be in BR.

So basically they are saying they are not taking any action at the minute because I owe money to others apart from creditor petitioning?

If you are in an IVA and enforcement proceedings were started relating to a pre IVA debt before the IVA they cannot be continued due to the IVA 'moratorium' so this may be what the notice relates to.
