I am so confused and really need some help, in September 2014 I had completed 5 years of my IVA but there was a small amount of equity in my property, obviously I couldn't remortgage so duly filled in the annual review form and struggled to get any remortgage rejection letters so was told to send screenshots, this I did and received an email back saying it would be discussed with a supervisor and I would hear from them. My circumstances had changed considerably having to reduce my working hours from full time to part time due to ill health I just wanted to get this IVA finished so I could retire (I am 63). I waited to hear from Clear Debt but nothing until March 2015, yes I know I should have chased it but so much going on in my personal life, the letter started with 'on March 2015 your creditors agreed to a mass variation that will now allow me to close your IVA .........' From that I assumed my IVA was finished, such a weight off my shoulders, I was able to retire. Yesterday I received a review form I was so confused so phoned clear debt and they told me it hadn't finished, but I haven't paid anything since last September and no-one from clear debt has ever contacted me, I feel incredibly stupid but so worried as I am now retired and only have my pension and pension credit, I have severe health problems and don't know what to do.

Hi, I'm sorry to hear this and you really don't need the added stress. I would contact them forthwith and let them know your circumstances and ask if they would propose the creditors take what is paid to date to conclude the IVA because of your changed circumstances and health problems.
I hope you get this sorted asap leaving you debt and stress free to move forward in your retirement.

Hi. I would suggest you do as Lesley suggests and that you address the email to David Mond ( david.mond@ ....).

Hi Barbara hopefully David will sort this for you but if not I suggest you send them a written request for an explanation of what is going on. Make surer you send it via recorded delivery. You can then escalate this to a complaint if they do not deal with it satisfactorily.

Thank you for e-mailing me.
I will review your case today and revert back to you shortly.
Just for the benefit of the others reading this post, the letter stated:-
“On Friday 20th March 2015 your creditors agreed to a mass variation that will now allow me to close your IVA and issue you with any relevant certificate if all the expected contributions have been made.”
I appreciate you have since acknowledged that you mis-read the letter, nevertheless, I will endeavour to find a workable solution as I do appreciate that mistakes can happen and I don’t want to see your IVA fail due to what I’m sure was genuinely an honest mistake on your part.
I look forward to working with you to help to resolve things for you.

In July I put this post on and David Mond said he was going to do a review and revert back to me....... I'm still waiting!

Hi Barbara - I suggest you chase him again and if no reply quickly then put in writing formally to them and follow up with a formal complaint.

Thank you Lisa, I had 2 phone calls from cleardebt one telling me I owed over £2000 into my IVA, the other telling me I needed proof of my ill health and that was the reason I retired, ok I can understand proof required of ill health but I was past retirement age. I sent an email to Mr Mond outlining my concerns that I sent in all documentation required last year but never heard anything until this year if it had been dealt with then my IVA would have been finished now. I received a quick response from Mr Mond but although he has said it would be put before creditors to accept payments to date I still need medical proof of ill health which I am now organising, there was no mention of why this was not dealt with earlier. I do understand no company is perfect and mistakes can happen just an admission that I had been overlooked would be good. I just hope cleardebt don't drag their feet any longer.

I am usually a very patient person probably because of working at a crematorium for years dealing with the bereaved! my patience is now wearing thin, today I have received 2 letters from cleardebt one a notice of breach the other giving me 28 days to remedy the arrears and a copy of the supervisors annual report, so very annoying if they had bothered to send me any correspondence last year there would not be a breach I would have carried on paying and it would now be ended. My IVA started in 2009 and with an extra year through being unable to release equity would have taken me to 2015, what is it with this company do they not think people have enough to contend with, what next????

Just a thought, should I have received a supervisors report last year and should I have received a letter stating as unable to release equity I would have to pay for another year, would a company usually wait a whole year before saying you are in arrears?
So angry!!!
