I've been in my Iva since November 2009 I emailed my ip last week to ask when my last payment would leave my bank. The reply was January 2015. I've made 7 more payments since January ! But was told it could take 16 weeks for them to give me my over payments back. Can they do this? £2940 is sitting in there account .

If you are paying by Direct Debit, they shouldn't have drawn the payments, which makes them more at fault.
They have your money, to which thay are not entitled -- demand it is returned immediately.

I paid by standing order so do you think I should still email them ?

If you pay by Standing Order then you can cancel that now and then ask for the money back.

Write a formal letter asking for a full refund within 14 days, post recorded delivery

Agree with the others, the time span they've given you is totally unacceptable.

I've emailed them but I will follow up with a letter like Andy suggested . It normally takes over five days for a response to my emails .[:)]

doesn't DD have a guarantee thing as well where you can get your money back pronto?

Ginger - is it Standing Order or Direct Debit?

If the former you can stop the payments now and tell them to refund the money, if the latter then stop the DD and tell them not to take any more money from your account and also to refund the money asap.

Complain to their bank as well, but let them know you are doing this, they should know that too many complaints = DD being taken off them, and you're might be the one that seals the deal, tell them that once the money is back in your account you'll stop complaining.

Kallis3 it was a standing order which I have canceled now . Just can't understand why I wasn't told months ago that it was my last payment in January and they have let me continue with my payments.

They should have told you but at least you've now got that bit of extra money each month and hopefully a nice lot of back payment to be sent to you.
