hi have a month till the end of my iva was with mel now with creditfix they are now saying im in breach due to arrears had 2.5 months worth with mel due to job loss but credit fix have lost 2 payments and cant find them have sent them copys of bank statements showing money has left my account what can I do with only a month to go

Continue pushing and if need be make a complaint especially if you can prove that payments have left your account.

They should have picked up on this earlier if they thought arrears were building up.

You need to prove that the money is in their account, not simply that it's left yours. Your bank should provide documentation to show which account the money went in to. Send them this and if they can't find it, that's their issue.

CF have provided minimal documentation and information since they took on PJG clients.

We have to assume that everything is running correctly because they seem to make it up as they go along.

Surely you can get a bank statement? I would fax it to them too - and get a fax reciept to prove they recieved it? Its discusting losing your hard earned money when you most likely struggled and went with things to make that payment.

Hi send thnm a formal written complaint via recorded/registered post. Include evidence of the 'missing' payments from your Bank statements. Get the Bank to give you clarification too as Relieved suggests and include this if you can.

Now in a similar situation linked to inaccurate records but if we do what they ask we will overpay!

You won't be overpaying - the IVA is complete.

In line with previous PJG clients our first payment was available for the creditor meeting.

They are trying to say that we have to pay right up to the date of that meeting which would make 61 months.

This is worrisome, I have 5 months to go with CF and suspect I'll be in the same position being an ex PJG client.

If the money has left your account and been sent to CFs account how can you be liable if they've "allegedly" lost it.

Does sound rather bizarre.

lifenoteasy I presume you are challenging this? surely counting from 1-60 inclusive is not that difficult? If you have to pay 12 payments over a year for instance, first payment Jan 12th payment Dec? or have I lost the ability to count?

If he has paperwork to show that the first payment was sent across then I can't see it being a problem.

We are challenging.

They couldn't even give us a specific date in the month that the last payment should be.
