Hi was just wondering when I receive my completion certificate can I apply for PPI? It was never part of my IVA?? thanks

Hi,

You can try but it will probably be seen as an asset even though it wasn't part of the IVA. You may find your completion letter reflects this.

Plus, if you chase it yourself you may find yourself open to fees.

It will be part of your IVA as it will relate to a pre IVA agreement and will therefore have been an asset due into your IVA estate (even though you didn't know about it at the time)

There is a Court appeal case happening in the summer Greene v Wright - depending on the outcome of this you could get to keep any PPI refund received post closure of your IVA.

However I suspect your IP wil either wait for this outcome or ask you to assign any PPI rights to be able to close your case in any event, sorry!

Hi There, I agree that unfortunately it will probably have to go to the company who were dealing with you as it seems to be the norm nowadays.

I have a question for Lisa Thomas .. what is the situation Greene v Wright??.. I keep hearing about this and have no idea what is happening.
Additionally, if the companies receive ppi on our behalf,and this case fails then is there a chance we may get something back form the ppi claimants?.. Thanks

I think Lisa knows the same as the rest of us - it's going to the appeal court but nobody knows when.

It is McCambridge Duffy that have brought the case but Michael Peoples seems to have disappeared recently.

The last I heard the appeal was due to be heard this summer. Michael's firm are involved so he may have a better idea on the date than I do!
