I entered into an IVA on 16.06.2010. I completed the IVA and my completion certificate is dated 05.11.2012.

I want to move on and get a mortgage in Aug this year so I want everything to drop off asap after June - I have written to all of my creditors and asked them to mark my file as settled and to remove defaults on my account after 16.06.2010. All have changed the default date to the date my IVA started but all of them have marked defaults up to the completion date of 05.11.2012.

Are monthly Default Notices allowed to be issued against me and appear on my credit file after 16.06.2010 and up to 05.11.2012? I didn't think creditors were actually allowed to issue/report these after the start date of my Arrangement.

The reason this is important is that Default Notices will remain on my credit file for 6 years. As such as they were issued after the start date of my IVA they will remain on my credit file after the record of the Arrangement has been removed. This will extend the period that my credit rating remains poor.

I've written to them all twice but have only achieved a correction of the date of default and "settled" updates. None have removed the defaults while the IVA was active and they all stop the date it was completed.

Have I misunderstood?

Regards

Tula

Hi,this is normal practice - as long as the original "default date" shown on credit file is the date before or the date IVA started then they will drop off after 6 years. Creditors will continue to show defaults, part settled, settled updates throughout the term of the IVA but don't worry it's the original default date that is critical.

Write to them and tell them to remove defaults back to the date the IVA was approved.

As regards a mortgage, speak to either Ryan or Shaun (details under the expert link on the left) as they have been instrumental in getting mortgages for a fair few posters.
