if my iva fails because of using the overdraft facility, is it possible to start over with a different ip?

Hi, yes you can have another IVA. They will possibly want to know why your original IVA failed etc., but it is possible.

I've just seen your other posting (assuming it's you). Like Kallis says, doubt it will fail because of this, this can be rectified. Can understand you asking the question though. Worth together, hopefully all will work out positively

It would seem harsh for an IVA to fail simply because you dipped into the overdraft. I'm surprised your Bank has allowed you to keep one. Speak to your IP as Kallis suggested and try and resolve this.

You can propose a further IVA but creditors may take a dim view of it if you fail this one and may not accept it second time around.

tbh i really would like to start over with a new IP
my current one (I'm not gonna name him) just doesn't seem to care at all
IVA has started over a month ago and he already starts to ignore my messages and emails
this is gonna be a nightmare

You will have to let your IVA fail before you can start again and you may find it difficult as you have not been in it for long and some IP's may not want to touch you.

It's usually three months before you get the failure notice.

I suggest you send all communication by recorded delivery and keep a copy of everything you send.

I would not recommend you fail your IVA one month after starting - creditors will not be impressed and you will be back to square one again with no guarantee of a second IVA.

If your IP fails to respond to communication follow his complaints procedure initially then follow up with the Gateway if necessary.

I normally contact him by sms or email
sometimes he answers and sometimes not, depends on how difficult the question is
obviously I can print out our email and sms communication if that can be used as a proof
especially my current issue, when NatWest deactivated my bank account because of the usage of overdraft - i emailed him over a month ago that I'm having £500 overdraft facility on my bank account and he didn't say anything

To be fair -- with some firms you will NEVER get any contact from your IP !

I still think you should think seriously about the IVA - it is not your IP's fault that Natwest have closed your bank account. They may be the same as HSBC and First Direct and trawl the Insolvency Register and close down accounts of anyone in an IVA even if they have no debts with them. They have done this once or twice recently.

Well what I mean is, when I went to the branch to ask about what is happening, they said they deactivated my account because of the usage of overdraft facility, and they clearly said that my IP should have told me that I'm not eligible for having an account like that.
I haven't received any correspondence from them whatsoever about that, they never even gave me any notice of what they were intending to do
My only problem is, I'm left without a bank account 9 days before the payday so I'm worried I'm not gonna be able to update my bank details at work on time..
Well there's still a chance though

Try an online application with nationwide for basic account. If approved will give you sort code and account number quickly.
