Hi I had an Iva back in 2010 which completed may 2015 and I received completion certificate.now most of creditors have fallen off my credit file except 1 which says account is delinquent.ive spoke to the creditors and Experian but the creditors say it's staying on because it's a true reflection of what happened.im lost for words as I was led to believe that from start date of Iva to 6 years later these would be on my file but once the 6 years past then I should have a clear file.please help me

Hi and welcome,

It will remain on for six years from the start of the IVA but then they have to remove it.

Send them a copy of your completion letter and tell them to remove any defaults back to the start of the IVA and that, at the end of six years, it should come off.

Give them 28 days otherwise you will escalate this and make a complaint.

They have a copy of my completion notice and still they won't remove the delinquent status.theyve marked it as settled back in May 2015 but say it's a true reflection of what happened and it's staying on.im trying too remortgage but can't move on until this is removed

You need to escalate this and make a complaint about them - this usually works.

As a matter of interest, which creditor is it?

As regards a remortgage, you could contact either Ryan or Shaun who post on here (details under the ask experts a question link on the left hand side of the page) as they have been instrumental with helping many posters on here.

Have a look at the ICO website - this you might find helpful.
Dont forget all you letters about this should go to the DATA Controller at the company (usually a diffrent address than customer services) they have a legal responsiblity for data

It is a company called creation finance I have looked at the ico website and thought about using them in my letter too creation in respect of taking it further.thankyou all for responding too me too

Has the 6 year anniversary actually passed yet? If so creditor must remove the default from their records.

I'd certainly suggest resolving this before you make any mortgage application because, although it won't necessarily have a detrimental impact, it's certainly going to limit your choice. Any specialist mortgage adviser with experience in this area should also be willing/able to help you resolve the issue.
