PPI to aperture

We are post iva by 7 years and have an email stating when our full and final was accepted we were not liable for any more payments not even ppi we also have cc
Today we received a ppi offer but the bank have sent it to aperture who are now in administration where'd we stand on this? Is this ours or creditors?

Aperture aren't in administration, they have however been recently sold to Jarvis.

This is just the live cases, however.

Did your full and final pay 100p/£ back to your creditors? If not, it's likely still due into the IVA as per the Green vs. Wright decision on 2017.

You could try contacting the Aperture Trusts team on ivatrusts@aperture.uk.com or give Jarvis a call on 0800 047 8681 and they should hopefully be able to advise, or at least point you in the right direction of who to contact.

The creditors were not paid in full but ppi was questioned in 2015 and we were told due to the terms of our iva no more money or ppi was payable I still have the copy of the email from apoeture

The following is what appeture sent us
work on the PPI support team. I was passed your email to Gareth in order to investigate. I can see that you since have spoken to Dale on our customer services
team. I attempted to ring you this afternoon but was unable to connect.

I can confirm that under the terms of the full and final settlement of your arrangements that no further funds are due in, including PPI.

Please accept my apologies for the incorrect information being advised earlier today. The majority of our client's terms and conditions means that a post
arrangement trust exists in order to deal with PPI, however, the wording of your settlement states "That the funds received to date, totalling £15,318, be accepted
as
full and final settlement of the arrangement". Further to this, trust wording was included in your closure report. This seeks to re-iterate the existing terms and as
such
does not apply to your case.

I have contacted your claims management company today to ensure they are not continuing to investigate missold payment protection insurance.

From that wording I imagine that the usual trust created by an IVA was formally severed on completion. So there would be nothing still in existence to claim the PPI other than you. Hopefully the team at ivatrusts can confirm this to the bank and the money should then be released to you.

Agree with Foggy, it would appear that the trust was severed upon completion but you should really contact them using the details I provided to gain some clarity.

Some lenders, if they have the fact that an IVA on their records, will automatically forward PPI funds to the IP - They may not know the specifics of the case or whether or not a post completion trust is in place and/or it has been vacated/severed.

You definitely need to speak to Aperture/Jarvis.

Could some one explain to me please why first dispute management are chasing this? We have had no communication or signed anything to give them the authority to do so? We have had no contact with appeture in the last 5 years

Ask them directly who has instructed them.

I have just spoken with first dispute and apparently my supervisor Jacqueline Wester an does not need any authority from us to chase ppi is this correct?

They do not need your authority but they do need to say what they are doing and continuing to do, not least so that situations like this do not arise.

They also need to justify the legal basis which would be in any communications they have with you directly.

As I have said we have had no contact since 2015 iva was completed in 2013
You can't speak with aperture over the phone you have to email which I have done both to my supervisor and the iva Trust just a waiting game now to see how long it takes for them to get back to me

Still no contact from apeture, so today have sent yet another email asking got a response in 7 days do you feel this is long enough given its already been 10 days before I take it further?

You are unlikely to get any help from Aperture as they no longer exist. You will need to contact Jarvis to see if they still have paperwork for you.

As I understand it jarvis took over live ivas mine is post closure by 7 years
