My car is worth £15000. I get DLA Mobility component. My car is registered taxation class as disabled. If I was forced to sell my car I would have to use the income of the mobility component to pay for a motorbility lease car . This would then leave me with less disposable income. Do you think in these circumstances ,that I would be forced to sell my car?

I am looking into an IVA. I have been in touch with a company who asked me the value of my car. Afterwards I thought about it and am now really worried that I might be expected to sell. I live in an isolated village and need a reliable car.
I hope you can advise me.

Hi Lady C
You will need to find out what portion of your DLA relates to travel allowance, and can therefore be used to fund a motability car. Whilst this would reduce your disposable income, creditors may well require you to sell your car in the circumstances, as the value of this is likely to far outweigh the reduction in disposable income.

Hi Melanie,
My Mobility component is £45 per week, which makes £195 cal month. My disposable income was calculated at £340 per cal month. It is quite a hefty sum plus my husband gets the same. The deduction of his also would leave us with nothing to pay. I'm not sure how much extra you have to pay for the motorbility car as a little mini type of car would not be suitable for me so it could substantially eat into his dla also.
I am so worried about this.
They could take anything but not my car. It is my lifeline.

You could put your case forward on the basis that you need to retain your car due to your disability, but you may need to be prepared to downsize for a cheaper model.
Is your income derived from DLA alone? If so, an IVA is unlikely to be a viable option for you in any case. And what savings would you make on car tax, insurance and maintenance each month?

Hi Melanie,
My income is not made up purely of DLA. I do have private pensions and other benefits.
I do not require Road tax because the car is for disabled purpose but I take on board what I would save on insurance and maintenance.

If you get a car from the motability scheme, they only take off you the mobility component. They dont touch the care component. You will still get free tax and the insurance and breakdown cover is also free.

Hi Melanie,
It's me again. How much do you think would be acceptable to spend if I sold my car and purchased another out of the proceeds before handing it over.
On refelction, I don't think it will really be viable to get a motorbility car as I don't think I'll have enough disposable income left to be accepted. I'll have to start thinking about what I can buy but need a bit of guidance here as to what I could spend.

Your husband's DLA wouldnt be touched if YOU got the car out of your own mobility.

Thanks Skint, If I get the most basic motorbility car they will take the mobility component. To get a bit bigger one I think you have to pay extra. I wouldn't be able to get in and out of a little car so presumable I would have to pay more. As my disposable income would not be that much without the mobility component I don't think I'll be accepted . It looks like it'll be an old banger for an old banger.

You can get a 7 seater people carrier for NIL deposit and they just take your total mobility off you.

To be honest this whole business is freaking me out.
It has only been a couple of days since I got the shock horror of exactly what I owe. I am now stressing and feeling ashamed yet grieving for a lifestyle that I used to be able to afford but have not accepted that I could no longer. I'm going on about my car like it's the be all and end all. I couldn't possibly tell my family even as it carries such shame so I've just got to sort out this first bit and hopefully it will get better.
