Basically my friend is having a problem with her bank account, it looks like they are taking her wages for the month as in the post Halifax bank help posts.

I have had dealings with companies house.
Aqua Credit cards are through a company called SAV credit Ltd (is a trade mark of).
The Aqua Credit Card is Issued by The Halifax Bank, (issuing company only) the credit is in agreement with Sav credit limited. soo the Halifax bank can not take funds from a Aqua customer as there is no credit agreement with them, also A LTD company is a legal entity of its own and for another company to take funds from a customers bank account is or should be illegal without customers agreement in the first instance. (also known as fraud).

Also if a company such as a bank does not leave enough money then what the law says that you should live on, this should also be illegal.

Can you help me as I think I may have the wrong end of the stick here. I have had a LTD company before and my solicitor says a subsidery of a company can not do what I have tried to explain above, can you verify this for me please......

I think that a bank can offset monies from various accounts within their organisation [it's called the right of off set].
I do agree that a hardship case can be sought in this instance.
I think that it is best to wait until Tuesday to see what has happened[if anything] to the wage payment as nothing can be done until then

SAV Credit Limited who operate the card are not part of HBOS.

They are VC funded - used to be Electra and another who funded them building a £300 million book which indicates they should have no right to offset ...... but this will of course depend on the t&c's of the credit agreement.

I now have a letterheaded letter from the customer repersentative of our local branch saying that the account is closed dated the 22nd march 2008, we woke up this morning to find that my partners wages have been put in this account, so we called them and they say that they know nothing about the account been closed.

They should not be able to offset this money should they? we no longer have a contract for this account and the funds should have been bounced back to the wages department at our lasses work....

Is this legal?

I would go straight back down to the branch and get the money out or get them to send it back to the sender.
If you have the letter you should be fine

transactions have been put on hold for the account as the iva is in process, we can not touch the funds in there.

Hey we got the money!!!.
went to one branch, they rang the head office and they said we were not entitled to the funds.
went to another branch said that we closed the account but the wages went in anyways... and they give us the money.... thank god they did not investigate the flag on the account. still does nt reson why they can make transactions from a closed account you your name....

Well done for your persistence with this matter, and also to the forum for giving you the advice and maybe the confidence to tackle the bank abut this.
