We have been bankrupt for 6 months now. We moved out of our house last year and left it to be repossessed as advised by CAB as the house was in negative equity and we could not sell it. We have not paid any mortgage or secured loan since last January 2007. We have been getting letters from Nrock about the mortgage arrears, these are now about £9,000 and they want paying!

Got a call today from Picture about secured loan, chasing payment! What???

Our OR has told us that any costs, arrears, interest and shortfall to Nrock and Picture are included in our bankruptcy so why are they still sending these letters and why have Picture now reared their ugly head again, chasing for money? Is it because the house is due for repossession next week and it’s a last ditch attempt to get money out of us?

I am afraid we put the phone down on the woman today from Picture, she would not listen and just kept on repeating her spiel!

Is there no end to this stress and hassle???

We are bankrupt too, the advice we were given is quote your bankruptcy number, tell them to contact OR and politely say goodbye and put the phone down. Must admit we haven't had any hassle, yet, we only filed on 13 Feb this year though so still time I suppose.

Hi
It could be as they are secured loans that the shortfall will only fall into your bankruptcy once the house is sold and the shortfall then becomes an unsecured debt and part of your bankruptcy.I would think that once repossessed calls will stop.

Jane

This is out of your hands and any residual shortfall is captured under the bankruptcy. You are well within your rights now not to discuss anything with these creditors, as the OR will have informed them of his/her appointment.

Thanks for putting my mind at rest, I have had another sleepless night!

I woke up worrying about all sorts of stresses, namely can Picture try and take us to court and get attachment of earnings for this debt? Aaaarhh

I know its covered in bankruptcy but in the small hours, when everyone is asleep, my brain starts going into overdrive!

The woman from Picture was not interested at all about what the OR said, she would not shut up long enough for us to even tell her to take the matter up with the OR!

I will just ignore them from now on!

As we continually tell you Jane - the secured shortfall is captured within the bankruptcy. Can you promise me that from today onwards you will not be concerned about this ever again.

I suggest that you change your phone number to avoid stupid calls like this.

We did change our home phone number, Picture rang my husband at work, so they must have the bankruptcy petition to know where he works and his phone number!!!!!

I am a bit annoyed actually.
