Hi, my partner and i have been in an joint iva for 4years, we are currently on a 6 month payment break which is due to end next month, and the iva payments are due to start again at the end of April. My partner has been out of work for the last 6 months due to health problems, she had an operation for internal scarring and just recently was diagnosed with skin cancer which has just been removed(yesterday) leaving a large wound on her face with 16 stitches. During the payment break we have managed on just my income and with child benefit, my partner doesn't qualify for any other benefits because of my wage. If my partner isn't successful in finding a job in time to get a full wage at the end of April the iva will fail, we have been told a letter of non compliance will be sent out at the end of this month if this months payment is not received. Can someone please explain what will happen once it has failed, how long have we got before the creditors start making our life hell again. really depressed and worried about the future, any advice really appreciated. Thanks, Andy.
Oh, the iva has already been extended by 6 months due to my partner been out of work a couple of years ago.

Hi Andy sorry to read about the health proboems your wife has ben having - I hope the operation was successful for her. It would be such a shame for your IVA to fail after being so far into it - some IPs would see what could be done - reduced payment frmo this point forwards, exptending the term further or seeing if payments to date will be accepted as final settlement - push your IP to see what they are prepared to do - don't accept that a fail has to automatically happen.

So sorry to hear your news and hope that the health issues are resolved soon.

Hi Tina, thanks for the reply, IP has said a reduction in payments isn't possible due to nothing been left after outgoings have been paid. They have been really good in the past (McCambridge Duffy), i had the option to go alone with the iva in the beginning but opted to do a joint one with my partner, i know this is going to sound really selfish but i would be so close to the end now with no missed payments (i haven't been out of work for 18 years), some of the reasons my partner has been out of work are due to silly days off she has taken, but just recently it's because of genuine illness. This whole thing has put a massive strain on our relationship and we are constantly arguing. Sorry for rambling on.

Good advice as always above :-) - also dont forget to contact Macmillian they have grants as well as a benefits and finanical advisers or even just some general support

Don't apologise Andy, the forum is here to try and put your mind ay rest.

McCambridge Duffy are an excellent company and we do have a poster from there on here. Hopefully he will pick up on this.

Never worry about rambling Andy - this is a place you can get it all out and have friendly ears to listen. I'm not surprised its taking its toll - there is a lot of worry and uncertainty around - try to work together on this together - looking back will only open negative feelings which won't help either of you.

Michael posts on here from McD and he is great - if anything can be done for you in McD he will try or will work with you on what to do next - he'll pick this up when he can.

I have just spoke to McCambridge Duffy who have put my mind at rest for the moment, it's not the end of the world as i thought, there are various options available to us. They are going to see if our creditors will accept what we have already paid as full and final settlement, i have gone from feeling very low to feeling excited, i know they could reject the offer but there is always that slim chance that they will accept it. I hope your partners health problems resolve positively. It is well worth looking into a welfare benefits check to make sure you are not missing out on any help that may be available. Contact McMillan cancer care for some help firstly

You are in excellent hands. McCambridge Duffy where our IPs and they provided us with everything we needed to get through.We put forward and F+F with help from family which was accepted.

I feel confident they will do their best for you in these difficult times.
