Hello, we have got a private rented house to move into by the 20th of July and we are going bankrupt, I just need some advice on whether it is better to go br whilst we are still in our own property or after we move? We have already got 2 months behind in our mortgage so they will be statrting repossession proceedings soon.

We br after we have moved into our new house, on the OR's advice we handed the keys back to the mortgage provider soon after.

Hi Helen

there isn't a rush in going Br.

Provided that you have sorted the new home out then it is not a problem. You may want to go Br on the 18th so that the new address is not in the papers and you will still be able to access the post as you won't have handed the keys back yet.

Also means you haven't got to panic about moving out all in 1 day

Hi thanks for your advice, its just that I don't want the new Landlord to know about the bankruptcy as he was very weary about us renting because my partner is self employed so we had to get a guarantor in order for us to get the property in the first place. I think perhaps we'd be better to do it just before we move like you suggest Paul so that we are still at our present address, but will we have to give the OR our new address when we go BR if we are still in our own property at that time?

Also, whn we move to the new address will it be diffcult for us to get a landline phone and broadband with us being BR?

you may have to pay a bond/deposit but you should be able to get connected.

If you have moved house before the bankruptcy, you will have to provide both addresses to the OR - and even if the move is after bankruptcy you still have to let them know about your current whereabouts.

Hi Melanie, I understand that aspect because obviously the OR will want to contact us in the future for reviews etc., but IF we have gone bankupt in our current property is the OR obliged to tell our new Landlord? Also, because my partner is self employed is it more advisable to get professional help with filling in the forms for the bankruptcy or do you think we can tackle them ourselves. He does have an accountant now and she has provided his Net income for us in writing on his income so far since he went self employed. We have been quoted £400 for a company to help us fill the forms in - does this seem reasonable, compared to other assistance companies as we have to raise this money as well as the £1000 we need to go BR.

The OR will not need to contact your new landlord if you move into the property after you have been made bankrupt. I personally do not feel that it is necessary to pay someone to help you fill in the bankruptcy forms - they are relatively simple even for self-employed people. If you can save £400 then that has to be a good thing at this time, especially if you are having to save up for the bankruptcy monies in any case.

£400 to just fill in forms seems quite expensive. Why don't you download the forms form the web ( or get a copy from your local court) and see what you think.

You can also fill the forms in inline if you prefer.

I found it easier to fill the forms in online as you can amend and save things as many times as you need to, and then you submit and print when you are finished and ready to go to court.
