Ah, I'm sorry to be clogging up the forum with lots of posts about my own situation....I know it's probably just worry and, to be frank, no amount of replies would really assuage it but I do have a question that's been bugging me for a bit.

In my F+F Proposal (raising the dividend from 28p/£ to 35p/£), my IP (W3, who have been fab so far and have, I understand, a pretty good general reputation) has outlined the reason for my F+F being put forward, which is a job offer on the table which was withdrawn due to my IVA status, but it's got me thinking....

- what if the creditors go, 'well, this new job might give us a higher dividend so we're going to sit and wait?'

I raised this with W3 when I received the revised proposal and they said that my future earnings weren't relevant to the proposal being made so not to worry.

But I am. As you can tell!

The reality of this new job is that there IS a salary increase but it'll be eaten up in fuel costs as there's an 80 mile round trip to make everyday (not the best but a LOT better than my current employment, believe me!), but no mention of that was made in the proposal.

I don't know why I'm posting other than for reassurance or advice, which are, I suppose, two damn good motivators.

Thanks for being here, by the way...I've only spoken to one of you off-forum but this is a real life-buoy at the moment, floating around, dodging the big waves and keeping afloat....[:)]

BC, first of all, you do not clog up the forum, we're all here for each other and the experts are here to help you, so you post away![:)] secondly, after reading all your previous posts, I still think it's a good offer for a darn good reason. I think it will be accepted. Maybe one of the experts can advise you on the job bit. Not long to go now, Viki X

Thanks Viki, just knowing that people are reading helps, to be honest. I agree with you about the offer itself, the increased dividend etc...just worried about the wording.

Are Melanie or Andy about?

Cheers Julie....it'll be done and dusted (one way or the other) 2 weeks today so I suppose I just have to sit it out. Still not convinced about the proposal....as ever, other peoples' experiences or opinions really helps

Don't quite understand why you are offering a full and final settlement on the basis of a withdrawn job offer. Can you elaborate please, and confirm the amount of disposable income you will be left with if the offer is accepted.

It's a police staff role. They offered the job and then withdrew it when they realised I was in an IVA. I spoke to them and they said that they'd be happy to re-offer me the job if I could provide a certificate of satisfaction. So, I've got the offer of £10,000 to propose as a Full and Final which would up the dividend for the creditors from 28p/£ in the original IVA to 35p/£

Disposal income - not much more than I would have before. The job itself requires an 80 mile round trip each day, so in all likelihood, slightly less than before. But that point HASN'T been put forward to the creditors, simply that in order for me to have this new job, I have to be out of the IVA. I've spoken to my IP about the wording of this; I don't want my creds thinking I'll be swanning off to earn 40k, because I'm not, but they said that my future earnings weren't relevant and that the offer is likely to go through

Aah - now I remember!!

This should sail through the creditors so long as your IP has properly explained the reasons for its presentation. I'll keep everything crossed for you!

Ah, OK....do you think that the reason as put forward - in order to progress in my career, I need to be free of the IVA - is sufficient?

To quote the proposal.....

'the debtor wishes to conclude her arrangement early as she has been offered an opportunity to progress her career by way of promotion however the debtor has been advised by her employers that in order to progress in her career, she must exit her arrangement with creditors.'

Is that sufficient, do you think? I'm worrying that it's not.
