Hi everybody, i have just got a tax rebate on my expenses that i get paid weekly to buy food and parking etc while driving my lorry.

I had declared my expenses to our IVA company at the startof our IVA and it was agreed that i would pay a set amount out of them each month to bump up our IVA payments, which is in writing.

So the question is would i have to pay any of this over?.Just for the record this rebate would be April 10 to April 11. Started IVA in October 10 so maybe a percentage from October 10 to April 11? or Nothing!!!!!

Just thought I'd catch up with this even though I haven't a clue! Didn't want you to think you were being ignored!

I think you need to speak to your IP about it - how much is the rebate worth?

Copy and paste your original question baldy and put it on the 'Ask a Debt question' - you might find that you get more answers.

It is all going to depend on how much and whether HMRC are a creditor. This may be seen as a windfall. See your T&Cs for further info. I am lucky my expenses are under £2500 and they are placed into my tax code. I suspect if this is extra monies they will want at least 50% Oct - Apr may be 100%. hopefully they don't want 100% of it all.

This should have beed addressed at the beginning by your IP. Your expenses should never have been used to 'bump up' your IVA payments and should have been totally ignored for IVA purposes. It would be a bit rich for your IP to now try and claim anything else but you will need to speak to them directly yourself.
