Hello. My mother sadly died recently, I have been left a bungalow, with my brother, half each. My IVA has nothing to do with him. If he refuses to sell, what powers do my creditors have? If I tell them I want to sell, and pay them, but my brother is refusing what can they do ?

Hi, Mick, very sorry to hear the sad news. I really have no idea and would be interested to hear what the experts say. But, thinking out loud, if push comes to shove the creditors could eventually push for bankruptcy on the grounds your weren't complying with the IVA ( even through no fault of your own) and in BR the OR has the power to take possession and sell from under you.

Hi mick1971 - welcome to the forum and I am also sorry to read of your mother's recent passing.

Does your brother have any funds to buy you out of your share of the bungalow?

Thanks for the replies. Sadly brother has no money. Now we will have to pay council tax on it whilst sitting empty too. Guess we'll have to sell.

Our council gives an exemption for 6 months if empty following a death -- worth asking ... not all do.
