Hi All
My ex-wife has now been removed from the account and it`s only in my name, my iva proposal will be sent to my creditors hopefully this week, can they still pursue her for payment on the overdraft

No they can not but I am surprised that your bank did allow you to remove her name from the account eventhough the account has been overdrawn.

Hi,
The bank have withdrawn the overdraft and passed to collections, i checked online banking last night and the account is only in my name, so i presume that the overdraft has been changed to my name solely?

Hi,
Forgot to mention that i fear the bank will take a hard stance on this and probably say no at the creditors meeting, they have around 33% of the vote, they actually sent me a financial difficulty booklet which states about doing an iva so they must no i`m struggling, just hope they look at it in a kind way, the bank is lloyds tsb

That bank are usually very supportive of IVAs. So long as your IP properly explains the reasons for your wife being removed from liability, this ought to be acceptable. And if it is not, you really cannot change anything at this stage, so if you need to do something to deal with your debts then go for it!

Hello crg,
Thanks for giving us an update on your situation, Im glad that everything has turned out for you.
In my experience I have found Lloyds TSB receptive to IVA's, I would advise your I.P of the situation with your bank account just to keep them in the loop.

I am in agreement with the other experts that ordinarily Lloyd TSB are supportive of IVAs.
