what will happen if the baliffs have already call and taken a walking possesion on my goods

Well these goods will be sold at auction and the proceeds taken off your debt[this will have increased due to costs].

If necessary, and you are thinking of entering into an IVA, get your IP to obtain an Interim Order to stop this action from progressing until you are able to finalise your proposals. Is this a H M Revenue & Customs debt by chance, and are you running a business?

Have the bailiffs been in and had you sign a walking possession agreement ?

If so your goods are at imminent risk of leaving and I believe I'm right in saying that at this point the bailiffs can break in to take them if needs be.

If they are County Court bailiffs pursuing a debt your best bet would be to make an application to suspend the warrant on form N.245 from the Court while you negotiate with the creditor, unless you are entering an IVA in which case you should proceed as described above.

Thanks for the advice. Iam not a business and am unsure of going into a IVA due to the set up costs etc

I do not understand how much it will cost to get help from Insolvency practitioner

A reputable insolvency practitioner will not charge you any fees up front until your proposals have been prepared and are ready to be issued to the creditors. So long as you have a good proposal to make, the insolvency practitioner will know that if they get it accepted then they will eventually get paid. There is therefore some incentive to work hard for your client - which should go without saying.

The insolvency practitioner's fees are only payable with the agreement of creditors, and are drawn down at periodic intervals from the contributions you make to your IVA.
