I am 35yrs old both me and my husband are in full time employment, we believe we can be helped with an IVA with our situation, but we are only migrant workers with a limited leave to remain visa in the UK (but hopefully in a few months time we will qualify for an indefinite leave (settlement visa) to remain in the UK). any advice would be much appreciated. Thanks!

Hi Cheyenne and welcome to the forum

Are your debts all based in the UK? And if so, how much do you owe. So long as you have had a permanent UK address for the last 6 months, technically you could qualify for an IVA, but most practitioners may be nervous about taking you on as clients given the uncertainty of your continued residency.

Hello Cheyenne,

In your case it may be better to go into a Debt Management Plan until your settlement visa is approved. Could you provide how much your debts are? Who are your creditors? What is your disposable income (income minus general living expenses)?
