I am considering bankruptcy. I have a huge debt (£25,000) which an ex partner arranged with bank, then faxed me docs to sign, and foolishly I did, 2 months later he left... I have made no repayments since.

I have also got a council housing overpayment (which is unjustified but they would not listen) which to value of £1455, this has been to court and I am due a means assessment.

As I am just about to loose my job and have no further means of income, I want to move back home (abroad) and start afresh, can this be done.. I am not sure what to do...

I noted that you have to be a uk citizen with UK passport to declare bankruptcy.. is this so?? I am Danish, danish passport, lived in UK for 14 yrs.

Bankruptcy would help you to get a fresh start. With little or no income and being in rented accomodation you have nothing to offer to your creditors.

I know.. but can I declare bankruptcy being a non UK citizen and also, will the Council debt be considered non-dischargable.

So long as you have British Residency, you can declare yourself bankrupt.

With regards to the council housing benefit overpayment, councils differ on this question all over the UK, some will discharge overpayments whereas some will not.

You would need to ask your council regarding this or perhaps the local CAB who may have previously dealt with your council regarding a similar situation.
