Has anyone heard of the IVA council just recived letter from them saying i may have been mis-sold my iva. Are they legit or just trying to get my money.All answers gratfuly recieved.

I too have just recieved one of these letters this morning,but am quite annoyed as the letter hadnt been folded properly so any one would be able to see what the letter was bout with out even opening it!Big letters REF:ACCUMA INSOLVENCY PRACTITIONERS.
Yes im in an iva but doesnt mean i want the b***** world to know about it.
Ive a good mind to ring the company up & complain!

From the IVA Council.
We are not going to give too much away as we don’t know who is asking the questions. However here are a few facts about us.
We DONT CHARGE FEES! IF we feel that (like us) someone has been mis-sold an IVA we will put them in touch with a licensed debt adjuster to help. These people have agreed that no matter what the circumstances they will NEVER charge someone more than the equivalent of 3 months IVA payments to sort the situation out. In many cases the cost is less and in some cases nothing at all. Bear in mind that the ‘Sausage machine factories have piled people into IVAs that would have been far better suited to Bankruptcy.
We may have been wrong to ‘advise’ people to stop paying their IPs until it’s clear that they have been mis-sold. This has been rectified and all further correspondence will read differently. We are a made up of a group of victims that are incensed by some of the greedy actions of IPs We are not insolvency practitioners.
We will not stop giving people a voice and a platform to seek redress. As for ‘class action’, we have a plan, it’s being put together now and as these forums are read by people that either don’t agree or understand what we are about.
It is time that the whole country was aware of the blatant and mass mis-selling scandal that has passed through the UK like an epidemic. If these companies succeed in closing us down (which they wont!) we will be up the next day under a different name, website and just carry on regardless.
If they have done nothing wrong then why are they so worried? (may be a guilty conscience?)
We have asked some of the people we have helped so far for their thoughts and no doubt they will start appearing g on the web soon.
The louder the IVA factories shout, the more attention they are drawing to the whole situation. GOOD! Let’s let them hang themselves.
The internet is a big place and whatever lies, miss information and accusations they make up about us, all they are really doing is putting doubt in people’s minds. Eventually people will realise that they HAVE been mis sold. If you owe money to your creditors HOW is it in you or your creditors best interest to pay £7500-£10k or more to an IP? Whatever mud they sling at us is just a smoke screen to hide that fact.
If you are an ethical IP and you are giving genuine advice and recommend an IVA to someone for whom it gives genuine benefit then carry on we are not after you. We are after the mass call centre IVA factories staffed by commission based salesmen and not insolvency practitioners with IPs who have been bought and paid for.
That our position and we WILL NOT BE SILENCED.
As to the question asked how qualified are we? We have all been ripped off by people with insolvency qualifications so we regard the ownership of an IP licence as no qualification at all!

I don't think you'd find a single person on this site that wouldn't be sympathetic to anyone who had genuinely been mis-sold an IVA.
With that in mind why don't you answer some of the entirely reasonable and fair questions put to you by other posters?

I personally have no intention of silencing anyone who is fighting for a cause they believe to be true.
If you are after those ripping people off or miss-advising consumers, good luck to you – but please, please do not fall into the trap yourself, and cause more damage than good.
A general mud chucking exercise will not help!
There are good and bad in all industries mine included. I have met some real genuine people, especially on this forum who are in the business to help other people – sure they charge a fee – people have to live, and putting together an acceptable proposal for an IVA is not (as I have found out after months of research) an easy job. All general mud chucking will do is damage consumer confidence as a whole.
Get your facts right and be true to the cause!
Your website upsets more people than it helps – design your own website, tell the facts and show true case studies. If you are truly confident of your facts, publish the bad guys names. You will then not need to worry about ‘class action’ (which by the way, can not be carried out in the UK yet) they will take you to court and if you win, they will pay your costs.
Otherwise get off the soapbox and do some further research and talk to some real experts – get both sides of the story!

If anyone has been "mis-sold" an IVA that would be a matter for ICAEW not for a company set up in order to make money from others misery.
As Melanie will confirm I have worked in the Debt Industry now for nearly 10 years. In that time many people have jumped on the "bandwagon" and have made sausage factories out of people in debt which I personally find deplorable. But it now seems that someone has had a lightbulb moment and thought of a way to make money on the back of those sausage factories.
Anyone seeking advice should always seek this from at least 2 or more companies and anyone feeling that they have been mislead should contact the various different governing or licencing bodies which oversee such companies.
Sorry rant over....

Well that was interesting.. Ive read these posts and the other one and have had a good rummage around the website.
A couple of observations
1) the web site has been set up to look semi official - the section about giving BR details that will be passed on to the Insolvency Service in particular is likely to upset the IS and is of very dubious legality.
2) the general tone is amateur and strident and verging on a rant.
3) Council - ok who is on it , how many members, are they accountable
4) The website and correspondence is costing someone money, its not a registered charity , so who is funding it and why - where do the funds come from .
Sorry this sounds like a scam.
If anyone who has received a flyer feels concerned about it please refer it to your local Police station and ask them to refer it to their High Tech Crime Unit or SOCA team

Just one further point that i think needs answering IVAcouncil, why are you using the DTi and FSA logos if you are not registered or authorised to use them and why is the website designed to look like the insolvency services one?

Questions
1]Do you earn a commision from the debt adjuster
2]Even if the debtor did get a refund of fees[VERY UNLIKELY] they are back in the same position as before,so the options available are bankruptcy or DMP.In the case of bankruptcy any returned money would be paid into the bankruptcy.
3]How can anyone take your advice seriously when you admit that you have made a fundamental error in advising people to stop paying their IVAs ?

Somehow I don't think that they will post back Andy.
But in the spirit of giving everyone a hearing perhaps we could ask IVAcouncil to explain exactly what they believe the appropriate criteria for an IVA is?
After all, if they hold themselves out to be able to advise when an IVA has been mis-sold, then it follows that they will also know when one is appropriate.
You never know, they may have some interesting views.
We await your view IVAcouncil.

i agree melanie, it should be put to bed, just feel sorry for anyone who actually falls for this sort of thing in their desperation,hopefully they will follow correct procedures if they are not happy with services received or think they have been mis sold.
