Has anybody any experience of dealing with hsbc whilst waiting for their proposal to be drafted?
My proposal is currently being drafted by clearstart and I have missed 1 payment with hsbc. So far they have called every day this week (well, sat, mon and today)and every time I have explained the situation and given them the name and number of the man i am dealingf with. Today I get some man getting quite threatening because I cannot afford to make even a token payment and he started saying that the next step is to demand full settlement or bailiffs!!
Time after time I have told them to contact clearstart but they just say it is not up to them to contact them!!

Well your IP should certaintly have contacted them to advise them of their involvement, but to be honest creditor call-centres do not appear to take any heed of what their customers or the professionals representing them say.
I would refer this to your IP and get them to confirm that they have at least written to HSBC.

Hi Martha ,I have my iva with clearstart. My iva was approved Jan 2008.My hubby and i had the same problem with some creditors demanding payments we couldnt afford and threatening baliffs. We told clearstart who advised us not to worry to much and just to tell them basically what you have . That they are arranging an iva proposal for you and pass them clearstarts number.Even now after our iva has been approved we get about 2 creditors who still ring for a payment and they give us both a bit of grief. Hang in there it will be sorted soon for you .

I changed my phone number so nobody could call me, alternatively, go and get an answering machine then you can just let the machine get it

Oh dear very distressing isn't it? All these people on the end of the phone have a single objective and that is to persuade you to pay some money (of any amount) As you have only missed one payment they will attempt to make you feel guilty, use threats etc. These threats are all empty especially as you have only missed one payment. If you have no money to give them, then tell them that. Don't argue with them ( they may say things like " do you have Sky? Yes? Well you could cancel that and use the money to pay off some of your debt to us" Be polite but firm remind them of how you addressing your debts and ask for a contact number from them so you can keep them updated with the progress of your IVA. I tried using my IP's name and got the response " your debt is with US Mr Maxdebt and we will speak to you about it!" As I said at the beginning.. every one of these phone calls is about the same thing... getting you to pay them something, anything. You are doing the very right thing by addressing your debt issues [:)]
