I have received a letter from the iva council, I dont believe a word of the information in it, I phone to find out how they got my details they told me from the register, My question is, they have told me that it is illegal to take disability benifits into acount, on my income, is this right or more bull.

Hi pitbull

they would have got your details from the insolvency register and they seem to be sending a lot of letters out of late.
If you are happy in your iva and were advised of all your options when you took it out - then this letter will be one for the bin

ALL income must be taken into account when looking at an IVA, to suggest that you can hide an income or that it is illegal is just downright wrong.

There is no law to say that benefits cannot be included into an IVA or BR for that matter, weather creditors accept them are another matter.

But i assume your creditors did accept them and like Emma said if you are happy with your IVA and given all the choices then you should not have a problem.

What they probably mean is that IVAs are not suitable for people whose income solely derives from benefits. A lot of people in this industry share this view, but I do not as the creditors were presumably happy to lend to you in the knowledge that you were receiving benefits, so what is the difference if you can afford to make ongoing repayments?
