i have about 20000 of debt i have just become a single mother on benefits, in a rented home. i had someone post a letter through the door last night a collector. i have no money at all and am very depressed with the recent loss of my mum i really want to file for bankruptcy will the collectors/debitors still have to be payed?? please can you give me infomation on what to do

Hi Amanda and welcome to the forum
It certainly sounds as if, given your circumstnaces, that bankruptcy would be the best option for you to make a fresh start.
As you are living on benefits, the cost of bankruptcy proceedings will be reduced to £335, and you will need to make an application in your local Court.
The application forms are easily downloaded from the Insolvency Service's website, which gives a lot of information on how to make your application and what will happen after a bankruptcy order is made.

Hello Amanda, sorry to hear this.
You could try your local Citizens Advice Bureau, they should be able to advise and assist you on all your options including bankruptcy.
Your local bureau may be able to write to your creditors / collection agencies and request a temporary hold on any recovery action while you decide on a course of action and remember collection agencies cannot enter your property and sieze goods.
The CABs usually have a supply of bankruptcy petitions and court fee exemption forms (ex160)or you can obtain these from your local county court and as Melanie says they can be downloaded.
If you do decide on bankruptcy as your long term option the CAB may be able to assist you in completing your petition, it is important that the petition is completed properly and that you have had proper advice on bankruptcy, our local courts always ask this.

i have had someone come last night a collector what should i do if he comes back as i am very worried. i have telephoned the courts and she has explained everything to me about it and is sending out the forms if anybody comes to my address what shold i say as i am very worried and scared

Tell them that you are in the process of declaring yourself bankrupt and have no assets or money which can be made available to them. And I strongly recommend you taking the advice of the CAB if you feel that you can no longer cope with the stress in the meantime.

what do i do i have debts of unpaid bills but i got a car from the carshop and apparantly the car wasnt on finance it was a loan the company gave me i had checks done on the car and it was hp clear. i had to sell the car as spares as the engine broke and i couldnt afford to pay for the repair. what will happen with that?? as i said i was told the finance wasnt finance it was a loan. many thanks for all the info, i am very worried about everything as i have just blocked it out wiv the grieving of my mother and the break up wiv my ex.

Was the collector from a finance company or a collections agency.
Was the collector calling on you about the car debt?

You will need to check whether the finance agreement was HP or just an unsecured loan to asceratain whether it was rightfully yours to sell. Do you still have a copy of the original agreement?

Hi Amanda
I just wanted to say 'hello' and welcome to the forum. It must be a really horrible time for you, especially being on your own with a child/children ... you can really feel quite isolated can't you. I sometimes think I'm the only one who cares about ME as it's difficult dealing with it all alone.
Do keep in touch with the Forum ... there are lots of experts here to give you good, sound advice ... and many more of us who are/have been in a debt crisis so you are amongst friends here and have a bit of company and moral support from today as you start to get things sorted out.

HI Amanda,
As you said in an earlier post you have had the car checked and has shown has HPI clear and have since sold the vehicle.
This debt will simply be included into the bankruptcy and treated like all the other debts.
Have you replaced the vehicle with another?

dont have the agreement i am going to the cab 2 day to see wat they say about the car as this is the one thats really bothering me av been told i can go to prison for it by my ex partner is that true?? wat will the bankruptcy include??

he tld me as well that even if i go bankrupt they still come in my home and take everything luxuary tv etc.

When you are bankrupt it is very unlikely that the Trustee will be interested in your domestic assets - unless they are of material value.
