Hi just wanted to say hello I am now just taking my first steps to a IVA so far it's been a very painful experience i never thought i would have to take this route but after getting married and having to fight the UK Home office for the right of my wife to live in the UK I'm now at the point of financial meltdown.

Everything has gone wrong in the last couple of months bank now has stopped my overdraft etc.. and eaten into all my salary have nothing left to pay the rent or the rest of my creditors kinda scary at the moment but just have to keep going but i'm most worried about my wifes visa hearing we will be getting a date soon and the last thing i wanted is to have to start doing an IVA

I am still collecting data from my all my creditors but i think the total amount will come to something like 35,000 I have contacted Debt free direct,

One of first problems is that i need a new bank acc Lloyds i can't use and they are about to start legal thats what they have said but have not received anything from them also i have an old business acc that i have been using not good but i need to close this as well as i don't the hassle of talking to tax man re what is income and what is my salary from my now full time job

Salary is about 18k

There are few bank accounts to look at. The coop cashminder with visa electron, natwest step with the solo card and there is always thinkbanking thought there is a 12.50 monthly charge but they will accept all and though some criticise the account I have found it invaluable.

You need to open a new bank account as soon as possible. Make sure that it does not have any connections with any of your creditors.

Co-op and Nationwide are two good ones to use.

You can't have an overdraft facility either, although if you can get a cheque book and debit card, that will be ok.

Welcome to the forum and please follow the brilliant advice you get here both from experts and those who are going through the IVA process (which,hopefully will soon include us!)

I've no wish to pry into your personal circumstances but as far as I know, as long as you can maintain your wife without recourse to public funds then the Home Office ought to grant her Indefinite Leave to Remain. However, they do often try to insist that the application be made from her country of origin rather than from the UK. I hope you have a good Immigration lawyer on your case.

My wife is still in the Philippines i met her in the UK nearly three years ago and we got married last November we married in the Philippines and we have a good lawyer and some good friends who have helped to pay for the legal fees so far.

I am trying desperatly to keep my wife out of all this mess i don't want her to come to the UK and then find she has to start help pay of my debts, that's the last thing i want.

We have been told that we have a good chance of winning though i have not informed my lawyer of the lasted update on my financial posistion as we are due to get the hearing date some time after the 10th of September.

Is your hearing a tribunal appeal in the UK or the original application with the BHC in Manila?
Posting this partly out of curiosity but also to bump you to the top for an expert to pick up on your IVA issues.
