I am in real need of some advise. I have just received a letter from my IVA company, Grant Thorntons, saying that we are in default of our IVA due to arrears/assetts pledged?
Firstly, the letter come on a Saturday, when they are closed and you cant speak to anyone (Typical)and secondly, the letter inside has no name or reference on it?
I'm not sure what to do, we make regular monthly payments to Synergence (formally My Vesta)and we have just received a letter from GT saying that they will be collecting the payments as from September.

Has anyone else had something like this before?

We have been in the IVA just under a year (sept08) and we have never missed a payment so im not sure what they are referring to?

Then I wouldn't worry Susan, I know it's horrible not being able to do anything over the weekend, but call them first thing Monday and if you get no joy, email your IP directly. X

Thanks both, the letter looks like a standard letter they send out, it's not even addressed to us it just says Dear Client and the envelope is just addressed to my partner but we are in a joint IVA??

The only thing i can think of is that we have recently changed our car (going form 2 cars to 1) but they wasnt included in the IVA assetts and we needed to do this due to the awful inflation.

Had you informed you IP that you had changed your car(s)? If not, I don't see how they could have known and marked you down for default.

Anyway, surely cutting down to one car instead of two would be a good thing - unless of course you have bought a Lamborghini?[:D][:D]

We havent informed them as yet (only just happened) as the sale of the 2 cars paid for the one and it was only £5000 and we are still paying the same for petrol and insurance, if we wouldnt have sold them and bought the one, we would have probably by now been paying double the amount we were allowed when we first took out the IVA.

We think we have sussed out what we have done wrong. We have accidently gont over the personal credit amount we were allowed as we thought it was a joint amount and as we are under the amount joinly, we thought that was ok (stupid, i know) so hopefully if we get the amount paid off, they will see that it was a mistake on our part....fingers crossed x

You definitly need to speak to them.

I'd like to know how they found out though if you haven't told them.

If you haven't missed any payments then this letter sounds to be a mistake. I would have thought that going over any personal credit amounts would bring about possibly a rap over the knuckles but not a default.

I am sure that when you come to speak to GT on Monday all will become clear, they are a very respected and professional company. As there is little that you can do at the moment try and put it to the back of your mind and enjoy the sunshine tomorrow [:)]

It sounds a bit strange to me
If you have missed no payments then I can see no problem.
Could be a simple mistake on GTs part with the wrong letter going out.

quick update, GT has informed me that it was an error and aparently, i was not the only one that received these letters.

All that stress and worry over nothing, and on a lovely sunny weekend as well!
