Hi there. I am currently in the process of sorting out an IVA and have a creditors meting on the 6th August (fingers crossed).

Most of my creditors have been fairly understanding except for Royal Bank of Scotland. They are in the process of taking me to court to get the money I owe them. I received a letter the other day stating my case had been sent to County Court for enforcement and I have 1 month to pay up.

Will an IVA cancel this judgement out? Should I contact the court? Will my IP be able to hold proceedings?

Would appreciate some advice.

Forward any correspondence to your IP & they will sort it.

Each time RBS contact you just inform them you are in the process of arranging an IVA. They will continue to hassle you until its finalised but this is perfectly normal.

I will go along with Jinx send the letter to your IP. I had a similar letter before my IVA was agreed and I didn't hear any more. It is a worry when these types of letters arrive I just sent everything to my IP and left it to them to sort out and I just told telephone callers I was setting up an IVA and the IP phone number. Companies will try to get their money and until the IVA has been agreed they will try to get their money I was lucky that the calls stopped very soon after the IVA was agreed but before I dreaded answering the phone and the post arriving.

Hi looktothefuture, if RBS have given you one month to pay up, and your meeting is on the 6th, I would say you would be ok.

I would certainly inform your ip of this letter, and if they phone again, just tell them that you are going for an IVA.

They should already have been informed about this anyway by your IP.

They are obviosly trying hard [:)]

Your creditors meeting on 6th August will beat them to it then they will have to simply comply with everyone else [:)]
