Two months into IVA, I have two creditors (Barclaycard, and RMA who are acting on behalf of Barclays) who appear to be denying that we're in an IVA, deny they're recieving payments, and both of them have demanded money.

Barclaycard have additionally carried on sending me monthly statements, with interest frozen but late payment charges and payment protection still being added to the outstanding balance.

I've contacted the IP but want a second opinion on what if anything I should be saying to these people when they ring me? I understood that being in an IVA they were contractually obliged to stop getting more money off me?

If they are included in your IVA then you are legally protected. It's a case of one department not notifying the other. I'm sure the calls will stop as soon as all the information filters through. Make sure your IP knows and maybe just don't answer the calls. X

Hi there.
Tell them to check the insolvency register whilst you are on the phone, if they wont, ask for a manager. they can do absolutely nothing as you are protected by the iva.

Send all your statements to your IP as well. Don't let the creditors bully you, and if they refuse to believe you, just put the phone down on them.

They can do nothing.

What I recommend clients to do is send any documents in, that way I can contact the department/person directly.

If you are getting phone calls get the direct number and name of the person you are speaking to and then call your IP and give these details to them. But the best thing is as stated above refer them to the IVA register and advise them of your court reference number (which should be on your chairman's report)

All your creditors are bound by the IVA so you have no worries.As advised just send details of creditors chasing toi your IP.
At the end of the day they are wasting their time[and yours]and any costs etc post IVA will be invalid.

This seems to be happening a lot just lately, creditors either phoning or writing long after the IVA has been approved.

Wonder where the breakdown in communication is,and why this is suddenly happening?
