Hi - I have been in an IVA since Mar 06. on the 20th Mar I put forward an offer to the creditors via my IP to pay off my IVA early. I originally owed £18k have paid off £4k and have offered £10k.

I still haven't heard anything from the creditors, my IP said that it used to be that the creditors had 36 days to reply and now its 28 so I should hear soon. It's likely that I will be loosing my job soon due to a reorganisation (I am a contractor so will just not get a renewal of my contract). I have explained this to my IP as I think it should make a difference to the final decision but my IP said it won't be taken into account. He also said he doesn't want to rush my case through....? I am getting the impression he is fobbing me off and I'm pulling my hair out worrying about this. Is there anything I can do? [xx(]

It should make a difference to the outcome if you were to become unemployed because then they wouldnt get anything else.

Has a date been set yet for a variation meeting?
If it has then you should have a decision that day. If it hasnt then you need to find out from your IP when this is likely to take place.

Have you been sent a copy of the report that has gone out to all your creditors yet?

Thanks guys, I'll get in touch now and see if they have either a date or a copy of the report for me.

Unbelievably I've just had this response:

"Hi Penny, the report has just been sent out today to Creditors and also a copy is on its way to you today First Class.
Once again we apologise for the delay however this has now left our offices and the creditors will be made aware shortly of the proposed offer.
Again we will keep you up to date with this and if you do have any problems or queries please do not hesitate to call me on 0870 977 8100.
Thanks"

I put the offer forward on the 20th March... I have had several conversations with my IP regarding this, at which time they have told me the offer has been sent and it's not their fault it's taking so long. And now they have admitted they have only just sent the offer!!?? I am livid. Is there someone I can complain to?

Keep an eye out in the post for a report now. The meeting date should be on there.
Keep your chin up, it could all be over soon.

Although communication has been very poor, i dont think the time you have waited so far is exceptionally long. Bear in mind, your IP would have had to prepare the report and im sure you are not his only client.

Just sit tight and wait now.

To be honest it's not so much the time as much as the lies and excuses. Why couldn't they just say "it will take a while to prepare the report" - that would have done. He had given me 5th May as a date I would hear either way - I've even had discussions with him about my job being under threat to which he said he understood and that he would do his utmost to get a reponse soon!!?? I don't feel like I can trust another word they say.

I don't want to rant on, I'm sure you've heard enough already. Obviously there are people out there in much worse situations. I just feel like I am at the mercy of these people and I am not sure they can be trusted. I've been treated pretty badly throughout the length of my IVA so far so if this goes through I think its right that I make a formal complaint to stop anyone else having to go through the same nightmare. Is there an official ombudsman for IVAs - are they even regulated?

Was it your actuall IP that told you all the lies or was it just another member of staff?

The problem is, if its a large firm acting for you, you very rarely get to speak to the same person twice so these people dont have proper knowledge of your individual case.

I am by no means sticking up for them, merely wondering if who you have been dealing with is really qualified to tell you anything anyway.
